                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to recreational fishing limits for certain species on the
 1-3     Toledo Bend Reservoir and Sabine River; providing a penalty.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter B, Chapter 66, Parks and Wildlife Code,
 1-6     is amended by adding Section 66.112 to read as follows:
 1-7           Sec. 66.112.  RECREATIONAL FISHING LIMITS IN TOLEDO BEND
 1-8     RESERVOIR AND SABINE RIVER. (a)  This section applies only to
 1-9     recreational fishing in:
1-10                 (1)  the Toledo Bend Reservoir; and
1-11                 (2)  that part of the Sabine River between Louisiana
1-12     and Texas.
1-13           (b)  A person may take in one day not more than:
1-14                 (1)  eight bass of the genus Micropterus of 14 inches
1-15     or more in length;
1-16                 (2)  25 white bass;
1-17                 (3)  five striped bass and hybrids of striped bass, of
1-18     which not more than two may exceed 36 inches in length;
1-19                 (4)  50 freshwater crappie or their hybrids, also known
1-20     as white perch or sac-a-lait;
1-21                 (5)  25 blue catfish of 12 inches or more in length;
1-22                 (6)  25 channel catfish of 11 inches or more in length;
1-23     or
1-24                 (7)  25 flathead catfish  of 14 inches or more in
 2-1     length.
 2-2           (c)  A person may not possess more than twice the number of
 2-3     fish provided in any subdivision of Subsection (b).
 2-4           SECTION 2. Section 66.121, Parks and Wildlife Code, is
 2-5     amended to read as follows:
 2-6           Sec. 66.121.  PENALTY. A person who violates Section 66.109,
 2-7     66.110, 66.111, or 66.112 [66.117(b) of this code or a regulation
 2-8     adopted under Section 66.115 of this code] commits an offense that
 2-9     is a Class C Parks and Wildlife Code misdemeanor.
2-10           SECTION 3. (a)  The change in law made by this Act applies
2-11     only to an offense or other violation committed on or after the
2-12     effective date of this Act.  For purposes of this section, an
2-13     offense or violation is committed before the effective date of this
2-14     Act if any element of the offense or violation occurs before that
2-15     date.
2-16           (b)  An offense or other violation committed before the
2-17     effective date of this Act is covered by the law in effect when the
2-18     offense or violation was committed, and the former law is continued
2-19     in effect for that purpose.
2-20           SECTION 4.  This Act takes effect immediately if it receives
2-21     a vote of two-thirds of all the members elected to each house, as
2-22     provided by Section 39, Article III, Texas Constitution.  If this
2-23     Act does not receive the vote necessary for immediate effect, this
2-24     Act takes effect September 1, 2001.
