A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the creation, composition, and operation of certain
1-3 district courts.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter C, Chapter 24, Government Code, is
1-6 amended by adding Section 24.542 to read as follows:
1-7 Sec. 24.542. 397TH JUDICIAL DISTRICT (HIDALGO COUNTY). (a)
1-8 The 397th Judicial District is composed of Hidalgo County.
1-9 (b) The 397th District Court shall give preference to cases
1-10 and proceedings under Title 3, Family Code.
1-11 SECTION 2. Effective January 1, 2003, Section 24.534,
1-12 Government Code, is amended to read as follows:
1-13 Sec. 24.534. 389TH JUDICIAL DISTRICT (HIDALGO COUNTY). [(a)]
1-14 The 389th Judicial District is composed of Hidalgo County.
1-15 [(b) The 389th District Court shall give preference to
1-16 criminal matters.]
1-17 SECTION 3. Effective January 1, 2003, Section 24.543,
1-18 Government Code, is amended to read as follows:
1-19 Sec. 24.543. 398TH JUDICIAL DISTRICT (HIDALGO COUNTY). [(a)]
1-20 The 398th Judicial District is composed of Hidalgo County.
1-21 [(b) The 398th District Court shall give preference to
1-22 family violence and criminal matters.]
1-23 SECTION 4. Section 24.549, Government Code, is amended to
1-24 read as follows:
2-1 Sec. 24.549. 404TH JUDICIAL DISTRICT (CAMERON AND WILLACY
2-2 COUNTIES [COUNTY]). The 404th Judicial District is composed of
2-3 Cameron and Willacy counties [County].
2-4 SECTION 5. (a) Subchapter C, Chapter 24, Government Code,
2-5 is amended by adding Section 24.556 to read as follows:
2-6 Sec. 24.556. 412TH JUDICIAL DISTRICT (FANNIN COUNTY). The
2-7 412th Judicial District is composed of Fannin County.
2-8 (b) The heading to Section 24.106, Government Code, is
2-9 amended to read as follows:
2-10 Sec. 24.106. 6TH JUDICIAL DISTRICT ([FANNIN,] LAMAR[,] AND
2-11 RED RIVER COUNTIES).
2-12 (c) Section 24.106(a), Government Code, is amended to read
2-13 as follows:
2-14 (a) The 6th Judicial District is composed of [Fannin,]
2-15 Lamar[,] and Red River counties.
2-16 (d) The heading to Section 24.482, Government Code, is
2-17 amended to read as follows:
2-18 Sec. 24.482. 336TH JUDICIAL DISTRICT ([FANNIN AND] GRAYSON
2-19 COUNTY [COUNTIES]).
2-20 (e) Section 24.482(a), Government Code, is amended to read
2-21 as follows:
2-22 (a) The 336th Judicial District is composed of [Fannin and]
2-23 Grayson County [counties].
2-24 SECTION 6. Subchapter C, Chapter 24, Government Code, is
2-25 amended by adding Section 24.557 to read as follows:
2-26 Sec. 24.557. 413TH JUDICIAL DISTRICT (JOHNSON AND SOMERVELL
2-27 COUNTIES). The 413th Judicial District is composed of Johnson and
3-1 Somervell counties.
3-2 SECTION 7. Subchapter C, Chapter 24, Government Code, is
3-3 amended by adding Section 24.558 to read as follows:
3-4 Sec. 24.558. 414TH JUDICIAL DISTRICT (MCLENNAN COUNTY). The
3-5 414th Judicial District is composed of McLennan County.
3-6 SECTION 8. Subchapter C, Chapter 24, Government Code, is
3-7 amended by adding Section 24.560 to read as follows:
3-8 Sec. 24.560. 415TH JUDICIAL DISTRICT (TRAVIS COUNTY). (a)
3-9 The 415th Judicial District is composed of Travis County.
3-10 (b) The 415th Judicial District shall give preference to
3-11 civil cases.
3-12 SECTION 9. (a) Subchapter C, Chapter 24, Government Code,
3-13 is amended by adding Section 24.561 to read as follows:
3-14 Sec. 24.561. 416TH JUDICIAL DISTRICT (PARKER COUNTY). The
3-15 416th Judicial District is composed of Parker County.
3-16 (b) Section 32.184(a), Government Code, is amended to read
3-17 as follows:
3-18 (a) The Commissioners Court of Parker County may budget for
3-19 and pay the judges [judge] of the 43rd and 416th judicial districts
3-20 [Judicial District] an annual salary not to exceed $7,800 for
3-21 performing judicial and administrative services.
3-22 (c) Section 43.125, Government Code, is amended to read as
3-23 follows:
3-24 Sec. 43.125. 43RD JUDICIAL DISTRICT. The voters of the 43rd
3-25 Judicial District elect a district attorney who represents the
3-26 state in all cases before the 43rd and 416th district courts.
3-27 (d) Section 152.1901(b), Human Resources Code, is amended to
4-1 read as follows:
4-2 (b) The juvenile board shall elect one of its members as
4-3 [district court judge is the] chairman [of the board].
4-4 SECTION 10. Subchapter C, Chapter 24, Government Code, is
4-5 amended by adding Section 24.562 to read as follows:
4-6 Sec. 24.562. 417TH JUDICIAL DISTRICT (COLLIN COUNTY). The
4-7 417th Judicial District is composed of Collin County.
4-8 SECTION 11. Subchapters B, C, D, and E, Chapter 24,
4-9 Government Code, are repealed.
4-10 SECTION 12. Chapter 24, Government Code, is amended by
4-11 adding Subchapter AA to read as follows:

5-17 Goliad, Gonzales, Guadalupe, Harris, Hidalgo, Hudspeth, Jackson,

5-19 Kenedy, Kerr, Kimble, Kinney, Kleberg, La Salle, Lavaca, Live Oak,
5-20 McMullen, Matagorda, Maverick, Medina, Nueces, Orange, Pecos,

5-24 SECTION 13. (a) Except as provided by Subsections (b) and
5-25 (e) of this section, the 397th, 412th, 413th, 414th, 415th, 416th,
5-26 and 417th judicial districts are created and this Act takes effect
5-27 September 1, 2001.
6-1 (b) Sections 5(b) and (c) of this Act take effect June 1,
6-2 2002.
6-3 (c) The local administrative district judge shall transfer
6-4 to the 412th District Court all cases from Fannin County that are
6-5 pending in the 336th District Court on September 1, 2001, and all
6-6 cases from Fannin County that are pending in the 6th District Court
6-7 on June 1, 2002.
6-8 (d) When a case is transferred from one court to another as
6-9 provided by Subsection (c) of this section, all processes, writs,
6-10 bonds, recognizances, or other obligations issued from the
6-11 transferring court are returnable to the court to which the case is
6-12 transferred, as if originally issued by that court. The obligees
6-13 in all bonds and recognizances taken in and for a court from which
6-14 a case is transferred, and all witnesses summoned to appear in a
6-15 court from which a case is transferred, are required to appear
6-16 before the court to which a case is transferred as if originally
6-17 required to appear before the court to which the transfer is made.
6-18 (e) Sections 11 and 12 of this Act take effect December 31,
6-19 2003.
