1-7 AN ACT
1-8 relating to the creation, composition, and operation of certain
1-9 district courts.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Subchapter C, Chapter 24, Government Code, is
1-12 amended by adding Section 24.542 to read as follows:
1-13 Sec. 24.542. 397TH JUDICIAL DISTRICT (HIDALGO COUNTY). (a)
1-14 The 397th Judicial District is composed of Hidalgo County.
1-15 (b) The 397th District Court shall give preference to cases
1-16 and proceedings under Title 3, Family Code.
1-17 SECTION 2. Effective January 1, 2003, Section 24.534,
1-18 Government Code, is amended to read as follows:
1-19 Sec. 24.534. 389TH JUDICIAL DISTRICT (HIDALGO COUNTY). [(a)]
1-20 The 389th Judicial District is composed of Hidalgo County.
1-21 [(b) The 389th District Court shall give preference to
1-22 criminal matters.]
1-23 SECTION 3. Effective January 1, 2003, Section 24.543,
1-24 Government Code, is amended to read as follows:
1-25 Sec. 24.543. 398TH JUDICIAL DISTRICT (HIDALGO COUNTY). [(a)]
1-26 The 398th Judicial District is composed of Hidalgo County.
1-27 [(b) The 398th District Court shall give preference to
1-28 family violence and criminal matters.]
1-29 SECTION 4. Section 24.549, Government Code, is amended to
1-30 read as follows:
1-31 Sec. 24.549. 404TH JUDICIAL DISTRICT (CAMERON AND WILLACY
1-32 COUNTIES [COUNTY]). The 404th Judicial District is composed of
1-33 Cameron and Willacy counties [County].
1-34 SECTION 5. (a) Subchapter C, Chapter 24, Government Code,
1-35 is amended by adding Section 24.556 to read as follows:
1-36 Sec. 24.556. 412TH JUDICIAL DISTRICT (FANNIN COUNTY). The
1-37 412th Judicial District is composed of Fannin County.
1-38 (b) The heading to Section 24.106, Government Code, is
1-39 amended to read as follows:
1-40 Sec. 24.106. 6TH JUDICIAL DISTRICT ([FANNIN,] LAMAR[,] AND
1-41 RED RIVER COUNTIES).
1-42 (c) Section 24.106(a), Government Code, is amended to read
1-43 as follows:
1-44 (a) The 6th Judicial District is composed of [Fannin,]
1-45 Lamar[,] and Red River counties.
1-46 (d) The heading to Section 24.482, Government Code, is
1-47 amended to read as follows:
1-48 Sec. 24.482. 336TH JUDICIAL DISTRICT ([FANNIN AND] GRAYSON
1-49 COUNTY [COUNTIES]).
1-50 (e) Section 24.482(a), Government Code, is amended to read
1-51 as follows:
1-52 (a) The 336th Judicial District is composed of [Fannin and]
1-53 Grayson County [counties].
1-54 SECTION 6. Subchapter C, Chapter 24, Government Code, is
1-55 amended by adding Section 24.557 to read as follows:
1-56 Sec. 24.557. 413TH JUDICIAL DISTRICT (JOHNSON AND SOMERVELL
1-57 COUNTIES). The 413th Judicial District is composed of Johnson and
1-58 Somervell counties.
1-59 SECTION 7. Subchapter C, Chapter 24, Government Code, is
1-60 amended by adding Section 24.558 to read as follows:
1-61 Sec. 24.558. 414TH JUDICIAL DISTRICT (MCLENNAN COUNTY). The
1-62 414th Judicial District is composed of McLennan County.
1-63 SECTION 8. Subchapter C, Chapter 24, Government Code, is
1-64 amended by adding Section 24.560 to read as follows:
2-1 Sec. 24.560. 415TH JUDICIAL DISTRICT (TRAVIS COUNTY). (a)
2-2 The 415th Judicial District is composed of Travis County.
2-3 (b) The 415th Judicial District shall give preference to
2-4 civil cases.
2-5 SECTION 9. (a) Subchapter C, Chapter 24, Government Code,
2-6 is amended by adding Section 24.561 to read as follows:
2-7 Sec. 24.561. 416TH JUDICIAL DISTRICT (PARKER COUNTY). The
2-8 416th Judicial District is composed of Parker County.
2-9 (b) Section 32.184(a), Government Code, is amended to read
2-10 as follows:
2-11 (a) The Commissioners Court of Parker County may budget for
2-12 and pay the judges [judge] of the 43rd and 416th judicial districts
2-13 [Judicial District] an annual salary not to exceed $7,800 for
2-14 performing judicial and administrative services.
2-15 (c) Section 43.125, Government Code, is amended to read as
2-16 follows:
2-17 Sec. 43.125. 43RD JUDICIAL DISTRICT. The voters of the 43rd
2-18 Judicial District elect a district attorney who represents the
2-19 state in all cases before the 43rd and 416th district courts.
2-20 (d) Section 152.1901(b), Human Resources Code, is amended to
2-21 read as follows:
2-22 (b) The juvenile board shall elect one of its members as
2-23 [district court judge is the] chairman [of the board].
2-24 SECTION 10. Subchapter C, Chapter 24, Government Code, is
2-25 amended by adding Section 24.562 to read as follows:
2-26 Sec. 24.562. 417TH JUDICIAL DISTRICT (COLLIN COUNTY). The
2-27 417th Judicial District is composed of Collin County.
2-28 SECTION 11. Subchapters B, C, D, and E, Chapter 24,
2-29 Government Code, are repealed.
2-30 SECTION 12. Chapter 24, Government Code, is amended by
2-31 adding Subchapter AA to read as follows:

3-2 SECTION 13. (a) Except as provided by Subsections (b) and
3-3 (e) of this section, the 397th, 412th, 413th, 414th, 415th, 416th,
3-4 and 417th judicial districts are created and this Act takes effect
3-5 September 1, 2001.
3-6 (b) Sections 5(b) and (c) of this Act take effect June 1,
3-7 2002.
3-8 (c) The local administrative district judge shall transfer
3-9 to the 412th District Court all cases from Fannin County that are
3-10 pending in the 336th District Court on September 1, 2001, and all
3-11 cases from Fannin County that are pending in the 6th District Court
3-12 on June 1, 2002.
3-13 (d) When a case is transferred from one court to another as
3-14 provided by Subsection (c) of this section, all processes, writs,
3-15 bonds, recognizances, or other obligations issued from the
3-16 transferring court are returnable to the court to which the case is
3-17 transferred, as if originally issued by that court. The obligees
3-18 in all bonds and recognizances taken in and for a court from which
3-19 a case is transferred, and all witnesses summoned to appear in a
3-20 court from which a case is transferred, are required to appear
3-21 before the court to which a case is transferred as if originally
3-22 required to appear before the court to which the transfer is made.
3-23 (e) Sections 11 and 12 of this Act take effect December 31,
3-24 2003.
