No. 3173 77R9203 QS-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the name and boundaries of the Port Isabel-San Benito 1-3 Navigation District. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. NAME CHANGE. (a) The name of the Port Isabel-San 1-6 Benito Navigation District is changed to the Port Isabel Navigation 1-7 District. A reference in another law to the Port Isabel-San Benito 1-8 Navigation District means the Port Isabel Navigation District. 1-9 (b) The name change made by this Act does not affect the 1-10 obligations or powers of the entity formerly known as the Port 1-11 Isabel-San Benito Navigation District. 1-12 SECTION 2. EXCLUSION OF TERRITORY. The boundaries of the 1-13 district are adjusted to exclude: 1-14 (1) the territory in the boundaries of the City of San 1-15 Benito as those boundaries existed on the effective date of this 1-16 Act; and 1-17 (2) the territory described as district lands west of 1-18 State Farm-to-Market Road 1847, as those boundaries existed on the 1-19 effective date of this Act. 1-20 SECTION 3. RIGHTS OF BONDHOLDERS. The exclusion of property 1-21 under this Act does not diminish or impair the rights of the 1-22 holders of any outstanding and unpaid bonds, warrants, or other 1-23 certificates of indebtedness of the district. 1-24 SECTION 4. APPORTIONMENT OF DISTRICT INDEBTEDNESS. (a) The 2-1 excluded property is not released from the payment of its pro rata 2-2 share of the district's indebtedness. 2-3 (b) The district shall continue to levy taxes each year on 2-4 the property excluded from the district at the same rate levied on 2-5 other property of the district until the taxes collected from the 2-6 excluded property equal the property's pro rata share of the 2-7 indebtedness of the district on the effective date of this Act. 2-8 The taxes collected shall be applied exclusively to the payment of 2-9 the excluded property's pro rata share of the indebtedness. 2-10 (c) The owner of any part of the excluded property at any 2-11 time may pay in full the owner's share of the pro rata share of the 2-12 indebtedness of the district. 2-13 SECTION 5. EFFECTIVE DATE. This Act takes effect immediately 2-14 if it receives a vote of two-thirds of all the members elected to 2-15 each house, as provided by Section 39, Article III, Texas 2-16 Constitution. If this Act does not receive the vote necessary for 2-17 immediate effect, this Act takes effect September 1, 2001.
