1-1 AN ACT
1-2 relating to the number of members of the governing body of certain
1-3 home-rule municipalities.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter C, Chapter 26, Local Government Code,
1-6 is amended by adding Section 26.046 to read as follows:
1-7 Sec. 26.046. SIZE OF GOVERNING BODY: CERTAIN
1-8 MUNICIPALITIES. (a) This section applies only to a municipality
1-9 with a population of 1.1 million or more that elects each member of
1-10 its governing body other than the mayor from fewer than 14
1-11 single-member districts.
1-12 (b) Notwithstanding a charter provision to the contrary, the
1-13 municipality may provide by ordinance for the number of districts
1-14 used to elect members to the municipality's governing body. The
1-15 ordinance may not provide for more than 14 districts.
1-16 (c) This section does not affect a mayor who, under a
1-17 charter provision, is elected in a municipality at large.
1-18 SECTION 2. This Act takes effect immediately if it receives
1-19 a vote of two-thirds of all the members elected to each house, as
1-20 provided by Section 39, Article III, Texas Constitution. If this
1-21 Act does not receive the vote necessary for immediate effect, this
1-22 Act takes effect September 1, 2001.
