No. 3193 1-2 (In the Senate - Received from the House April 30, 2001; 1-3 May 1, 2001, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 9, 2001, reported favorably by the 1-5 following vote: Yeas 5, Nays 0; May 9, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the number of members of the governing body of certain 1-9 home-rule municipalities. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter C, Chapter 26, Local Government Code, 1-12 is amended by adding Section 26.046 to read as follows: 1-13 Sec. 26.046. SIZE OF GOVERNING BODY: CERTAIN 1-14 MUNICIPALITIES. (a) This section applies only to a municipality 1-15 with a population of 1.1 million or more that elects each member of 1-16 its governing body other than the mayor from fewer than 14 1-17 single-member districts. 1-18 (b) Notwithstanding a charter provision to the contrary, the 1-19 municipality may provide by ordinance for the number of districts 1-20 used to elect members to the municipality's governing body. The 1-21 ordinance may not provide for more than 14 districts. 1-22 (c) This section does not affect a mayor who, under a 1-23 charter provision, is elected in a municipality at large. 1-24 SECTION 2. This Act takes effect immediately if it receives 1-25 a vote of two-thirds of all the members elected to each house, as 1-26 provided by Section 39, Article III, Texas Constitution. If this 1-27 Act does not receive the vote necessary for immediate effect, this 1-28 Act takes effect September 1, 2001. 1-29 * * * * *
