                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to conflicts of interest of Department of Information
 1-3     Resources employees.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 2054.022(b) is amended to read as follows:
 1-6           (b)  The department shall remove from the bidding process,
 1-7     including development of the proposal through award of the contract
 1-8     and contract negotiation, any employee who receives more than 5
 1-9     percent of the individual's income from any likely respondent to a
1-10     bid proposal issued by the department, or whose spouse is employed
1-11     by any likely respondent to a bid proposal issued by the
1-12     department.  [A person who is the spouse of an officer, employee,
1-13     or paid consultant of a business entity that has, or of a trade
1-14     association of business entities that have, a substantial interest
1-15     in the information resources technologies industry and that may
1-16     contract with state government may not be:]
1-17                 [(1)  a member of the board; or]
1-18                 [(2)  an employee of the department who:]
1-19                       [(A)  is exempt from the state's position
1-20     classification plan; or]
1-21                       (B)  [is compensated at or above the amount
1-22     prescribed by the General Appropriations Act for step 1, salary
1-23     group 17, of the position classification schedule.]
 2-1           SECTION 2.  This Act takes effect September 1, 2001.
