1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to updating address information on a list used to
1-9 reconstitute the jury wheel.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 62.001, Government Code, is amended by
1-12 adding Subsection (k) to read as follows:
1-13 (k) In reconstituting the jury wheel, the county or district
1-14 clerk shall update jury wheel cards to reflect addresses that have
1-15 been changed as provided by Section 62.0146.
1-16 SECTION 2. Section 62.0145, Government Code, is amended to
1-17 read as follows:
1-18 Sec. 62.0145. REMOVAL OF CERTAIN PERSONS FROM POOL OF
1-19 PROSPECTIVE JURORS. Except as provided by Section 62.0146, if [If]
1-20 a written summons for jury service sent by a sheriff, constable, or
1-21 bailiff is undeliverable, the county or district clerk may remove
1-22 from the jury wheel the jury wheel card for the person summoned or
1-23 remove the person's name from the record of names for selection of
1-24 persons for jury service under Section 62.011.
1-25 SECTION 3. Subchapter A, Chapter 62, Government Code, is
1-26 amended by adding Section 62.0146 to read as follows:
1-27 Sec. 62.0146. UPDATING ADDRESSES OF CERTAIN PERSONS IN POOL
1-28 OF PROSPECTIVE JURORS. If a written summons for jury service sent
1-29 by a sheriff, constable, or bailiff is returned with a notation
1-30 from the United States Postal Service of a change of address for
1-31 the person summoned, the county or district clerk may update the
1-32 jury wheel card to reflect the person's new address.
1-33 SECTION 4. This Act takes effect immediately if it receives
1-34 a vote of two-thirds of all the members elected to each house, as
1-35 provided by Section 39, Article III, Texas Constitution. If this
1-36 Act does not receive the vote necessary for immediate effect, this
1-37 Act takes effect September 1, 2001.
