                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to estimating the amount of revenue a state agency has
 1-3     lost from the sale of information because of a requirement to make
 1-4     information available on the Internet or accessible  under a
 1-5     request for public information.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1. Subchapter A, Chapter 552, Government Code, is
 1-8     amended by adding Section 552.0105 to read as follows:
 1-9           Sec. 552.0105.  LOSS OF INFORMATION SALES REVENUE. The
1-10     governing body of a state agency that has determined that a
1-11     requirement in law to make certain information available at cost in
1-12     response to a request for the information or freely available on
1-13     the Internet has the effect of significantly reducing the agency's
1-14     revenue derived from the sale of such information as compared to
1-15     information sales revenue collected before the requirement took
1-16     effect may:
1-17                 (1)  estimate, in cooperation with the Legislative
1-18     Budget Board, the amount of revenue lost as a result of the
1-19     requirement; and
1-20                 (2)  include the estimated amount in the agency's
1-21     legislative appropriations request.
1-22           SECTION 2. This Act takes effect September 1, 2001.
