No. 3228 77R9388 SMH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to containment systems required for certain underground 1-3 storage tanks. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter I, Chapter 26, Water Code, is amended 1-6 by adding Section 26.3476 to read as follows: 1-7 Sec. 26.3476. SECONDARY CONTAINMENT REQUIRED FOR TANKS 1-8 LOCATED OVER CERTAIN AQUIFERS. (a) In this section, "secondary 1-9 containment" means a method by which a secondary wall or barrier is 1-10 installed around the primary storage vessel of an underground 1-11 storage tank system in a manner designed to prevent a release of a 1-12 regulated substance from migrating beyond the secondary wall or 1-13 barrier before the release can be detected. A secondary 1-14 containment system may include an impervious liner or vault 1-15 surrounding a primary tank or piping system or a double-wall tank 1-16 or piping system. 1-17 (b) An underground storage tank system shall incorporate a 1-18 method for secondary containment if the system is located in: 1-19 (1) the recharge zone of an aquifer; and 1-20 (2) a county that: 1-21 (A) has a population of at least one million; 1-22 and 1-23 (B) relies on groundwater for at least 75 1-24 percent of the county's water supply. 2-1 (c) Section 26.3475(e) applies to an underground storage 2-2 tank system that is subject to this section as if a violation of 2-3 this section were a violation of Section 26.3475. 2-4 SECTION 2. (a) This Act takes effect September 1, 2001. 2-5 (b) This Act applies only to an underground storage tank 2-6 system that is installed, upgraded, or replaced on or after the 2-7 effective date of this Act.
