 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to a declaration for write-in candidacy for director of
1-10     the Midland County Hospital District.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION 1. Section 5A(c), Chapter 112, Acts of the 65th
1-13     Legislature, Regular Session, 1977, is amended to read as follows:
1-14           (c)  A declaration of write-in candidacy must be filed with
1-15     the secretary of the board of directors not later than 5 p.m. of
1-16     the fifth day after the date an application for a place on the
1-17     ballot is required to be filed in the election [30th day before
1-18     election day].  However, if a candidate whose name is to appear on
1-19     the ballot dies or is declared ineligible after the 43rd [33rd] day
1-20     before election day, a declaration of write-in candidacy for the
1-21     office sought by the deceased or ineligible candidate may be filed
1-22     not later than 5 p.m. of the 37th [27th] day before election day.
1-23           SECTION 2.  This Act takes effect immediately if it receives
1-24     a vote of two-thirds of all the members elected to each house, as
1-25     provided by Section 39, Article III, Texas Constitution.  If this
1-26     Act does not receive the vote necessary for immediate effect, this
1-27     Act takes effect September 1, 2001.
