A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to notice to higher education students of the sanctions
1-3 for failure to timely pay tuition and fees.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 54.007(c), Education Code, is amended to
1-6 read as follows:
1-7 (c) A student who fails to make full payment of tuition and
1-8 fees, including any incidental fees, by the due date may be
1-9 prohibited from registering for classes until full payment is made.
1-10 A student who fails to make payment prior to the end of the
1-11 semester may be denied credit for the work done that semester. The
1-12 governing board may not impose on a student any sanction authorized
1-13 by this subsection unless when the student registers or selects a
1-14 method of payment under Subsection (a), the governing board gives
1-15 to the student a written notice of possible sanctions that contains
1-16 [includes in any promissory note signed by a student] the following
1-17 statement printed in bold-faced type or in capital letters: "A
1-18 STUDENT WHO FAILS TO MAKE FULL PAYMENT OF TUITION AND FEES,
1-19 INCLUDING ANY INCIDENTAL FEES, BY THE DUE DATE MAY BE PROHIBITED
1-20 FROM REGISTERING FOR CLASSES UNTIL FULL PAYMENT IS MADE. A STUDENT
1-21 WHO FAILS TO MAKE PAYMENT PRIOR TO THE END OF THE SEMESTER MAY BE
1-22 DENIED CREDIT FOR THE WORK DONE THAT SEMESTER." The governing
1-23 board shall also include the statement in any promissory note
1-24 signed by the student. The governing board shall notify a student
2-1 of any delinquent tuition or fee payment as soon as practicable.
2-2 The institution's records may be adjusted to reflect the student's
2-3 failure to have properly enrolled for that semester.
2-4 SECTION 2. The change in law made by this Act applies
2-5 beginning with tuition and fees charged for the 2001 fall semester.
2-6 SECTION 3. This Act takes effect immediately if it receives
2-7 a vote of two-thirds of all the members elected to each house, as
2-8 provided by Section 39, Article III, Texas Constitution. If this
2-9 Act does not receive the vote necessary for immediate effect, this
2-10 Act takes effect September 1, 2001.
