                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the compensation of a former judge or justice while
 1-3     assigned as a visiting judge.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Sections 74.061(c) and (h), Government Code, are
 1-6     amended to read as follows:
 1-7           (c)  The salary of a retired or former judge or justice while
 1-8     assigned under this chapter shall be paid out of money appropriated
 1-9     from the general revenue fund for that purpose in an amount equal
1-10     to the compensation received from state and county sources of the
1-11     judge of the court to which the judge or justice [he] is assigned.
1-12     The salary of a retired or former judge or justice while assigned
1-13     shall be determined pro rata for the period of time that the judge
1-14     or justice actually sits as the assigned judge.
1-15           (h)  Notwithstanding Subsection (c), the salary from the
1-16     state of a retired or former judge or justice assigned to a
1-17     district court is determined pro rata on the sum of the regular
1-18     judge's salary from the county plus the greater of:
1-19                 (1)  the regular judge's salary from the state on
1-20     August 31, 1997; or
1-21                 (2)  85 percent of the regular judge's salary from the
1-22     state, or a greater percentage of that salary, not to exceed 100
1-23     percent, as established by the General Appropriations Act for any
1-24     fiscal year.
 2-1           SECTION 2. Sections 74.061(d) and (i), Government Code, are
 2-2     repealed.
 2-3           SECTION 3. This Act takes effect September 1, 2001, and
 2-4     applies only to the assignment of a former judge or justice made on
 2-5     or after that date.    An assignment made before the effective date
 2-6     of this Act is governed by the law in effect at the time the
 2-7     assignment is made, and that law is continued in effect for that
 2-8     purpose.
