 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     relating to the development, funding, and operation of the
1-11     Southeast Texas Biotechnology Park.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1. Subtitle F, Title 4, Government Code, is amended
1-14     by adding Chapter 488 to read as follows:
1-15              CHAPTER 488.  SOUTHEAST TEXAS BIOTECHNOLOGY PARK
1-16           Sec. 488.001.  COALITION ESTABLISHMENT. The Southeast Texas
1-17     Biotechnology Park Coalition is established.  The coalition is
1-18     composed of public and private health-related institutions, and
1-19     other private for-profit and nonprofit and governmental
1-20     institutions, and is established for the purpose of developing,
1-21     funding, and operating a biotechnology research and development
1-22     park to be known as the Southeast Texas Biotechnology Park.
1-23           Sec. 488.002.  PURPOSE; LOCATION. (a)  The park shall be
1-24     operated for the purposes of:
1-25                 (1)  furthering the mission of the coalition members;
1-26                 (2)  economic development of the state, including the
1-27     production of net revenue to the state and coalition members, from
1-28     the commercialization of biotechnology research;
1-29                 (3)  recruiting and retaining leading scientists and
1-30     established biotechnology enterprises; and
1-31                 (4)  supporting the growth and development of new
1-32     biotechnology enterprises.
1-33           (b)  The park shall be located in the area of Houston, Texas,
1-34     known as the Texas Medical Center.
1-35           Sec. 488.003.  COALITION MEMBERS. The membership of the
1-36     coalition may include any interested governmental or private
1-37     for-profit or nonprofit institution, including:
1-38                 (1)  Baylor College of Medicine;
1-39                 (2)  Johnson Space Center of the National Aeronautics
1-40     and Space Administration;
1-41                 (3)  Memorial Hermann Health Care System;
1-42                 (4)  Rice University;
1-43                 (5)  St. Luke's Episcopal Health System/Texas Heart
1-44     Institute;
1-45                 (6)  Texas Southern University;
1-46                 (7)  TIRR Systems;
1-47                 (8)  the University of Houston System;
1-48                 (9)  The University of Texas M. D. Anderson Cancer
1-49     Center;
1-50                 (10)  The University of Texas Medical Branch at
1-51     Galveston; and
1-52                 (11)  The University of Texas Health Science Center at
1-53     Houston.
1-54           Sec. 488.004.  NONPROFIT CORPORATION. The coalition may
1-55     establish a nonprofit corporation to develop and operate the park.
1-56           Sec. 488.005.  LAND AND INFRASTRUCTURE. The park may be
1-57     developed on land owned by the State of Texas and made available
1-58     for that purpose, as well as on land acquired by the state, the
1-59     nonprofit corporation, or a member institution for purposes of the
1-60     park.
1-61           Sec. 488.006.  INVESTMENT; FUNDING. (a)  The park shall be
1-62     developed as a public-private partnership in which both public
1-63     institutions and private entities contribute to the development,
1-64     funding, and operation of the park.
 2-1           (b)  Leases producing revenue to state institutions
 2-2     participating in the development of the park shall be at market
 2-3     rates.
 2-4           SECTION 2. This Act takes effect immediately if it receives a
 2-5     vote of two-thirds of all the members elected to each house, as
 2-6     provided by Section 39, Article III, Texas Constitution.  If this
 2-7     Act does not receive the vote necessary for immediate effect, this
 2-8     Act takes effect on the 91st day after the last day of the
 2-9     legislative session.
