 1-8                            A BILL TO BE ENTITLED
 1-9                                   AN ACT
1-10     Relating to county regulation of outdoor burning.
1-11           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12           SECTION  1.  Section 240.906 (f), Local Government Code, as
1-13     added by Chapter 1453, Acts of the 76th Legislature, Regular
1-14     Session, 1999, is amended to read as follows:
1-15           (f)  This section does not apply to outdoor burning
1-16     activities:
1-17                 (1)  related to public health and safety that are
1-18     authorized by the Texas Natural Resource Conservation Commission
1-19     for:
1-20                       (A) [1]  firefighter training;
1-21                       (B) [2]  public utility, natural gas pipeline, or
1-22     mining operations; or
1-23                       (C) [3]  Planting or harvesting of agricultural
1-24     crops; or
1-25                 (2)  that are conducted by a prescribed burn manager
1-26     certified under Section 153.048, Natural Resources Code and meets
1-27     the standards of Section 153.047.
1-28           SECTION 2.  This Act takes effect immediately if it receives
1-29     a vote of two-thirds of all the members elected to each house, as
1-30     provided by Section 39, Article III, Texas Constitution.  If this
1-31     Act does not receive the vote necessary for immediate effect, this
1-32     Act takes effect September 1, 2001.
