                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to county roads.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Chapter 445, Local Government Code, is amended by
 1-5     adding Subchapter D to read as follows:
 1-6              SUBCHAPTER D.  SPECIAL COUNTY ROAD ASSISTANCE PROGRAM.
 1-7           Sec. 445.101.  Distribution of funds.  On or before October
 1-8     15 of each year, the Comptroller of Public Accounts shall
 1-9     distribute such funds to counties for the Special County Road
1-10     Assistance Program as appropriated by the legislature.
1-11           Sec. 445.102.  Limitation of use.  All funds distributed
1-12     under this Subchapter shall be used exclusively for the support of
1-13     the county road system.
1-14           Sec. 445.103.  Distribution Formula.  Funds distributed under
1-15     this subchapter shall be allocated among the counties as follows:
1-16                 (1)  20% according to lineal county road miles,
1-17     determined by the ratio of the lineal mileage of county roads in
1-18     the county to the lineal mileage of county roads in the state,
1-19     according to the most recent County Road Inventory complied by the
1-20     Texas Department of Transportation.
1-21                 (2)  20% according to paved and concrete county road
1-22     lane miles, determined by the ratio of the mileage of paved and
1-23     concrete county road lane miles in the county to the mileage of
 2-1     paved and concrete county road lane miles in the state, according
 2-2     to the most recent County Road Inventory compiled by the Texas
 2-3     Department of Transportation.
 2-4                 (3)  20% according to the population in the
 2-5     unincorporated area of the county determined by the ratio of the
 2-6     population in the unincorporated area in the county to the
 2-7     population in the unincorporated area in the state, according to
 2-8     the most recent federal census.
 2-9                 (4)  40% according to the population in the county
2-10     determined by the ratio of the population in the county to the
2-11     population in the state, according to the most recent federal
2-12     census.
2-13           SECTION 2.  This Act will take effect immediately if it
2-14     receives a vote of two-thirds of all the members elected to each
2-15     house, as provided by Section 39, Article III, Texas Constitution.
2-16     If this Act does not receive the vote necessary for immediate
2-17     effect, this Act takes effect September 1, 2001.
