A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to payroll deductions for county employees.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Sections 155.002(a) and (b), Local Government
1-5 Code, are amended to read as follows:
1-6 (a) A request for a payroll deduction must:
1-7 (1) be in writing;
1-8 (2) be submitted to:
1-9 (A) the county auditor; and
1-10 (B) the county treasurer or another officer
1-11 performing the duties of the county treasurer as specified by law;
1-12 and
1-13 (3) state the amount to be deducted and the entity to
1-14 which the amount is to be transferred.
1-15 (b) A request remains in effect until [the county auditor
1-16 receives] a written notice of revocation signed by the employee is
1-17 received by:
1-18 (1) the county auditor; and
1-19 (2) the county treasurer or another officer performing
1-20 the duties of the county treasurer as specified by law.
1-21 SECTION 2. Section 155.021, Local Government Code, is
1-22 amended to read as follows:
1-23 Sec. 155.021. DEDUCTIONS ENUMERATED. (a) The county
1-24 treasurer or, if another officer is performing the duties of the
2-1 county treasurer as specified by law, that other officer shall make
2-2 the deductions from, or take other similar actions with regard to,
2-3 the compensation of county employees as required:
2-4 (1) for employee contributions for coverage under the
2-5 federal social security program in accordance with Chapter 606,
2-6 Government Code;
2-7 (2) for the purchase of annuities or for contributions
2-8 to investments for employees in accordance with Chapter 22, Acts of
2-9 the 57th Legislature, 3rd Called Session, 1962 (Article 6228a-5,
2-10 Vernon's Texas Civil Statutes);
2-11 (3) for the purchase of United States savings bonds
2-12 for employees in accordance with Chapter 606, Government Code;
2-13 (4) for employee participation in a deferred
2-14 compensation plan in accordance with Chapter 609, Government Code;
2-15 or
2-16 (5) for employee contributions to a retirement system
2-17 in accordance with Section 845.403, Government Code.
2-18 (b) An employee request for a payroll deduction described by
2-19 Subsection (a) must:
2-20 (1) be in writing; and
2-21 (2) be submitted to the county treasurer or another
2-22 officer performing the duties of the county treasurer as specified
2-23 by law.
2-24 SECTION 3. (a) This Act takes effect September 1, 2001.
2-25 (b) The change in law requiring a county employee to submit
2-26 a request for an employee payroll deduction to the county auditor
2-27 and county treasurer or other officer specified by law as provided
3-1 by Section 155.002(a)(2), Local Government Code, as amended by this
3-2 Act, and Section 155.021(b), Local Government Code, as added by
3-3 this Act, applies only to an employee request for a payroll
3-4 deduction submitted on or after the effective date of this Act. An
3-5 employee request for a payroll deduction submitted before the
3-6 effective date of this Act is governed by the law in effect when
3-7 the request was submitted, and the former law is continued in
3-8 effect for that purpose.
3-9 (c) The change in law requiring a county employee to submit
3-10 a written notice of revocation of the request for a payroll
3-11 deduction to the county auditor and county treasurer or other
3-12 officer specified by law as provided by Section 155.002(b), Local
3-13 Government Code, as amended by this Act, applies only to a
3-14 revocation submitted on or after the effective date of this Act,
3-15 and applies regardless of when the initial request for an employee
3-16 deduction was submitted.
