 1-7                                   AN ACT
 1-8     relating to the continuing education requirements for a county
 1-9     treasurer.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Section 83.003, Local Government Code, is amended
1-12     to read as follows:
1-13           Sec. 83.003.  CONTINUING EDUCATION.   (a)  Within one year
1-14     after the date on which a person first takes office as county
1-15     treasurer, the county treasurer must successfully complete an
1-16     introductory [a] course of instruction in the performance of the
1-17     duties of county treasurer.
1-18           (b)  After completion of the first year in office, a [A]
1-19     county treasurer must successfully complete in each 12-month period
1-20     at least 20 hours of continuing education [a continuing education
1-21     course] in the performance of the duties of county treasurer [at
1-22     least one time in each 24-month period].
1-23           (c)  The introductory course required by Subsection (a) and
1-24     at least 10 hours of the continuing education required by
1-25     Subsection (b) must be taken at an accredited public institution of
1-26     higher education.  The remaining required classroom hours, wherever
1-27     taken, must be certified by an accredited public institution of
1-28     higher education.
1-29           (d)  To satisfy the requirement of Subsection (b), a county
1-30     treasurer may carry forward from one 12-month period to the next
1-31     not more than 10 continuing education hours that the county
1-32     treasurer completes in excess of the required 20 hours.
1-33           (e)  For purposes of removal under Subchapter B, Chapter 87,
1-34     "incompetency" in the case of a county treasurer includes the
1-35     failure to complete a course in accordance with this section.
1-36           [(d)  A course required by this section must include at least
1-37     20 classroom hours of instruction in an accredited public
1-38     institution of higher education.]
1-39           SECTION 2. This Act takes effect September 1, 2001.
