1-1 AN ACT 1-2 relating to water quality management plans for agricultural and 1-3 silvicultural facilities. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 201.026, Agriculture Code, is amended by 1-6 adding Subsections (e), (f), and (g) to read as follows: 1-7 (e) At the request of the landowner, the state board may 1-8 develop and certify a water quality management plan for any 1-9 agricultural or silvicultural land in the state. 1-10 (f) A water quality management plan developed under this 1-11 section that covers land on which animal carcasses will be buried 1-12 must include: 1-13 (1) disposal management practices for the carcasses, 1-14 including a requirement that poultry carcasses may be buried on 1-15 site only in the event of a major die-off that exceeds the capacity 1-16 of a poultry facility to handle and dispose of poultry carcasses by 1-17 the normal means used by the facility; and 1-18 (2) burial site requirements that identify suitable 1-19 locations for burial based on site-specific factors including: 1-20 (A) land use; 1-21 (B) soil conditions; and 1-22 (C) proximity to groundwater or surface water 1-23 supplies. 1-24 (g) The commission may not require a landowner who requests 2-1 and complies with a water quality management plan under Subsection 2-2 (f) to record the burial of animal carcasses in the county deed 2-3 records. 2-4 SECTION 2.
