No. 3355 1-2 (In the Senate - Received from the House April 30, 2001; 1-3 May 1, 2001, read first time and referred to Committee on Natural 1-4 Resources; May 4, 2001, reported favorably by the following vote: 1-5 Yeas 6, Nays 0; May 4, 2001, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to water quality management plans for agricultural and 1-9 silvicultural facilities. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Section 201.026, Agriculture Code, is amended by 1-12 adding Subsections (e), (f), and (g) to read as follows: 1-13 (e) At the request of the landowner, the state board may 1-14 develop and certify a water quality management plan for any 1-15 agricultural or silvicultural land in the state. 1-16 (f) A water quality management plan developed under this 1-17 section that covers land on which animal carcasses will be buried 1-18 must include: 1-19 (1) disposal management practices for the carcasses, 1-20 including a requirement that poultry carcasses may be buried on 1-21 site only in the event of a major die-off that exceeds the capacity 1-22 of a poultry facility to handle and dispose of poultry carcasses by 1-23 the normal means used by the facility; and 1-24 (2) burial site requirements that identify suitable 1-25 locations for burial based on site-specific factors including: 1-26 (A) land use; 1-27 (B) soil conditions; and 1-28 (C) proximity to groundwater or surface water 1-29 supplies. 1-30 (g) The commission may not require a landowner who requests 1-31 and complies with a water quality management plan under Subsection 1-32 (f) to record the burial of animal carcasses in the county deed 1-33 records. 1-34 SECTION 2.
