A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to pull-tab bingo. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 2001.403, Occupations Code, is amended to 1-5 read as follows: 1-6 (a) Except as provided by this section, no more than one 1-7 bingo premises may exist under a common roof or over a common 1-8 foundation. 1-9 (b) This section does not apply if more than one premises 1-10 lawfully exists under a common roof or over a common foundation 1-11 under a license application filed with the commission on or before 1-12 May 23, 1997. The commission shall renew a license at the premises 1-13 that is otherwise in compliance with this chapter. 1-14 (c) Subsection (b) does not apply if a premises under a 1-15 common roof or over a common foundation ceases to lawfully exist. 1-16 (d) Subsection (a) does not apply to pull-tab bingo. 1-17 SECTION 2. Section 2001.406, Occupations Code, is amended to 1-18 read as follows: 1-19 (a) The rent charged by a licensed commercial lessor to a 1-20 licensed authorized organization to conduct bingo may not exceed 1-21 $600 for each bingo occasion conducted on the lessor's premises 1-22 unless the organization subleases the premises to one or more other 1-23 licensed authorized organizations to conduct bingo, in which event 2-1 the rent charged by the licensed commercial lessor may not exceed 2-2 $600. 2-3 (b) Rent for premises used for the conduct of bingo must be 2-4 paid in a lump sum. The lump sum must include all expenses 2-5 authorized by Section 2001.458 that are paid by the licensed 2-6 authorized organization to the lessor in connection with the use of 2-7 the premises. 2-8 (c) This section does not apply to the rent charged under a 2-9 lease or other contract in existence on May 31, 1989, and on file 2-10 with the comptroller on that date but does apply to the rent 2-11 charged under a renewal of or extension of that lease or other 2-12 contract. 2-13 (d) Subsection (a) does not apply to pull-tab bingo. The 2-14 commission may adopt rules to establish the rent to be paid in 2-15 connection with the conduct of pull-tab bingo. 2-16 SECTION 3. Section 2001.408, Occupations Code, is amended to 2-17 read as follows: 2-18 Subject to the commission's rules, bingo may be played using 2-19 a pull-tab bingo ticket. The provisions of Section 2001.419(b) and 2-20 (c) do not apply to pull-tab bingo. 2-21 SECTION 4. This Act takes effect October 1, 2001.
