                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the exemption of a public housing authority from
 1-3     competitive bidding requirements for certain activities.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 392.052, Local Government Code, is
 1-6     amended by adding Subsection (h) to read as follows:
 1-7           (h)  Competitive bidding laws, including Chapter 271, do not
 1-8     apply to an authority activity to develop a mixed-finance housing
 1-9     project as defined by 42 U.S.C. Section 1437z-7, if the housing
1-10     project otherwise complies with the procurement requirements
1-11     imposed by federal law and regulations.
1-12           SECTION 2.  The change in law made by this Act applies only
1-13     to a public housing authority activity that begins on or after the
1-14     effective date of this Act.  An activity that begins before the
1-15     effective date of this Act is covered by the law as it existed
1-16     immediately before that date, and that law is continued in
1-17     existence for that purpose.
1-18           SECTION 3. This Act takes effect September 1, 2001.
