                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to certain election processes and procedures.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Section 16.0332, Election Code, is amended by
 1-5     adding Subsection (d) to read as follows:
 1-6           (d)  During each month, the registrar shall post on the
 1-7     bulletin board used for posting notice of meetings of the
 1-8     commissioners court a list with the number of:
 1-9                 (1)  voter registrations canceled;
1-10                 (2)  voter registrations reinstated; and
1-11                 (3)  registered voters excused or disqualified from
1-12     jury service.
1-13           SECTION 2. Section 31.039, Election Code, is amended by
1-14     adding Subsections (g) and (h) to read as follows:
1-15           (g)  The administrator shall select for employment full-time
1-16     employees for the administrator's office in accordance with
1-17     criteria developed in consultation with appropriate authorities.
1-18           (h)  On the request of a deputy or any other person the
1-19     administrator may employ, the administrator may not require the
1-20     person to work both Saturday and Sunday during a voting period.
1-21           SECTION 3. Subchapter E, Chapter 31, Election Code, is
1-22     amended by adding Section 31.124 to read as follows:
1-23           Sec. 31.124.  ELECTION STAFF OF COUNTY CLERK'S OFFICE. (a)
 2-1     In this section, "county election officer" means for counties that
 2-2     do not have a county elections administrator, the county tax
 2-3     assessor-collector in counties in which the county clerk's election
 2-4     duties and functions have been transferred to the tax
 2-5     assessor-collector and the county clerk in other counties.
 2-6           (b)  The county election officer shall select for employment
 2-7     full-time employees for the office of the county election officer
 2-8     in accordance with criteria developed in consultation with
 2-9     appropriate authorities.
2-10           (c)  On the request of a deputy or any other person the
2-11     county election officer may employ, the county election officer may
2-12     not require the person to work both Saturday and Sunday during a
2-13     voting period.
2-14           SECTION 4. Section 63.009(a), Election Code, is amended to
2-15     read as follows:
2-16           (a)  Except as provided by Subsection (b), a voter who does
2-17     not present a voter registration certificate when offering to vote,
2-18     and whose name is not on the list of registered voters for the
2-19     precinct in which the voter is offering to vote, shall be accepted
2-20     for voting if the voter presents proof of identification and
2-21     executes the appropriate affidavits [an affidavit in accordance
2-22     with Section 63.010].
2-23           SECTION 5. Section 85.069, Election Code, is amended to read
2-24     as follows:
2-25           Sec. 85.069.  ELECTION OFFICERS SERVING BRANCH POLLING PLACE.
2-26     (a)  The authority ordering an election [early voting clerk] shall
 3-1     designate for each branch polling place a deputy early voting clerk
 3-2     and an assistant deputy early voting clerk in accordance with
 3-3     criteria developed in consultation with appropriate authorities [as
 3-4     the election officer in charge of the polling place].
 3-5           (b)  The composition of the full-time employees [set of
 3-6     election officers] serving under the deputy early voting clerk and
 3-7     assistant deputy early voting clerk at a branch polling place shall
 3-8     be designated in accordance with criteria developed in consultation
 3-9     with appropriate authorities [must provide representation for each
3-10     political party conducting a primary election in the county].
3-11           SECTION 6. This Act takes effect September 1, 2001.
