                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to inclusion of certain information on a highway
 1-3     information sign.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter D, Chapter 391, Transportation Code, is
 1-6     amended by adding Section 391.0936 to read as follows:
 1-7           Sec. 391.0936.  TOURIST ATTRACTIONS. (a)  In this section,
 1-8     "tourist attraction" means a cultural, recreational, or
 1-9     entertainment facility or an area of a natural phenomenon or scenic
1-10     beauty that is suited for outdoor recreation or that receives a
1-11     major portion of its income or visitors during the normal business
1-12     season from motorists not residing in the immediate area.  The term
1-13     does not include:
1-14                 (1)  a lodging facility; or
1-15                 (2)  a facility that is primarily devoted to the retail
1-16     sale of goods, unless the goods are created by individuals at the
1-17     facility or the sale of the goods is incidental to the facility.
1-18           (b)  Notwithstanding any other provision of this chapter and
1-19     subject to rules that the commission shall adopt to administer this
1-20     section, a municipality in the jurisdiction of which is located a
1-21     specific information logo sign is entitled, on application to the
1-22     commission, to have included on the sign advertising pertaining to
1-23     a tourist attraction to promote the general welfare, convenience,
 2-1     and enjoyment of travelers.  The information shall be included on
 2-2     the sign without cost to the municipality.
 2-3           SECTION 2.  This Act takes effect September 1, 2001.
