By Gallego H.B. No. 3440 Substitute the following for H.B. No. 3440: By Ramsay C.S.H.B. No. 3440 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the compensation of county sheriffs. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. SUBCHAPTER A, CHAPTER 85, LOCAL GOVERNMENT CODE is 1-5 amended by adding Section 85.0026 to read as follows: 1-6 SECTION 85.0026. COMPENSATION OF COUNTY SHERIFFS. (a) In a 1-7 county with a population of 10,000 or less, in which the salary of 1-8 a county sheriff is less than one-third the state salary provided 1-9 to a district judge, the county sheriff may receive from the state 1-10 supplemental salary compensation in an amount provided in the 1-11 General Appropriations Act. 1-12 (b) If any amount of compensation is waived by the sheriff, 1-13 the waived amount shall be used for expenses of the county 1-14 sheriff's office. 1-15 SECTION 2. This Act takes effect immediately if it receives 1-16 a vote of two-thirds of all the members elected to each house, as 1-17 provided by Section 39, Article III, Texas Constitution. If this 1-18 Act does not receive the vote necessary for immediate effect, this 1-19 Act takes effect September 1, 2001.
