A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the transportation of wine into the state by an 1-3 individual for personal consumption. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 107.08, Alcoholic Beverage Code, is 1-6 amended to read as follows: 1-7 Sec. 107.08. TRANSPORTATION OF BEVERAGES FOR PERSONAL 1-8 CONSUMPTION. (a) A person who purchases an alcoholic beverage for 1-9 his own consumption may transport it from a place where its sale is 1-10 legal to a place where its possession is legal without holding a 1-11 license or permit. 1-12 (b) A person may purchase wine and ship or cause to be 1-13 shipped the wine purchased to the person's residence for personal 1-14 use, if: 1-15 (1) the person purchases the wine while physically 1-16 present at a winery in Texas or another state or country; 1-17 (2) the person purchasing the wine is physically 1-18 present when the wine is delivered to the person's residence; 1-19 (3) the person making the sale has verified that the 1-20 person purchasing the wine is 21 years of age or older. 1-21 SECTION 2. Section 107.11, Alcoholic Beverage Code, is 1-22 amended to read as follows: 1-23 Sec. 107.11. IMPORTATION OF PERSONAL WINE COLLECTION. (a) A 2-1 person who is relocating a household may import, or contract with a 2-2 motor carrier or another person to import, a personal wine 2-3 collection as a part of that person's household goods. 2-4 (b) Section 107.07 of this code does not apply to a person 2-5 who is importing a personal wine collection under Subsection (a) of 2-6 this section. 2-7 (c) Wine purchased and shipped pursuant to Section 107.08 of 2-8 this code shall be treated as an addition to a person's personal 2-9 wine collection. 2-10 SECTION 3. This Act takes effect September 1, 2001
