 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to certain fees prescribed by the Texas Board of Health
 1-9     for the regulation of opticians.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1.  Section 352.054, Occupations Code, is amended to
1-12     read as follows:
1-13           Sec. 352.054.  FEES.  The board by rule shall prescribe fees
1-14     in reasonable amounts sufficient to cover the costs of
1-15     administering [necessary to administer] this chapter, including
1-16     fees for [in amounts not to exceed]:
1-17                 (1)  [$50 for] an initial application for a certificate
1-18     of registration;
1-19                 (2)  [$20 for] issuance of a certificate of
1-20     registration;
1-21                 (3)  [$30 for] issuance of a renewal certificate of
1-22     registration; and
1-23                 (4)  [$20 for] issuance of a duplicate certificate of
1-24     registration or duplicate renewal certificate of registration.
1-25           SECTION 2.  (a)  This Act takes effect September 1, 2001.
1-26           (b)  The Texas Board of Health shall prescribe fees under
1-27     Section 352.054, Occupations Code, as amended by this Act, not
1-28     later than January 1, 2002.  The amount of a fee under Chapter 352,
1-29     Occupations Code, in effect immediately before the effective date
1-30     of this Act shall remain in effect until the Texas Board of Health
1-31     adopts a new amount for that fee as required by this Act.
