                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to establishing a purchasing preference for calcium rich
 1-3     foods and drinks.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Chapter 38, Education Code, is amended by adding
 1-6     Section 38.013 to read as follows:
 1-7           Sec. 38.013.  CALCIUM INITIATIVE. (a)  this section applies
 1-8     to:
 1-9                 (1)  a governmental entity; or
1-10                 (2)  a business that contracts with a governmental
1-11     entity that purchases food or beverages to be processed and served
1-12     in a building or room owned or operated by the governmental entity.
1-13           (b)  This section does not apply to a state institution if
1-14     the director of the state institution determines that purchasing
1-15     high calcium foods and beverages would interfere with the proper
1-16     treatment and care of the state institution's patients.
1-17           (c)  High calcium foods and beverages are preferred supplies.
1-18     A purchasing agent shall give a preference to foods and beverages
1-19     that:
1-20                 (1)  contain a higher level of calcium than products of
1-21     a similar type and quality; and
1-22                 (2)  are equal in price or lower in price than products
1-23     of a similar type and quality.
 2-1           (d)  This section expires July 1, 2003.
 2-2           SECTION 2.  Notwithstanding Sec 38.013, as added by this Act,
 2-3     a purchasing agent who has entered into a contract with a supplier
 2-4     before July 1, 2001, to purchase food and beverages is not required
 2-5     to purchase high calcium foods and beverages if purchasing those
 2-6     products would change the terms of the contract.
 2-7           SECTION 3.  This Act takes effect September 1, 2001.
