                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to exceptions from limits on public school class sizes.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1. Section 25.112(d), Education Code, is amended to
 1-5     read as follows:
 1-6           (d)  On application of a school district, the commissioner in
 1-7     exceptional circumstances may except the district from the limit in
 1-8     Subsection (a) if the commissioner finds that an emergency exists
 1-9     that is beyond the control of the district and the limit works an
1-10     undue and substantial hardship on the district.  The commissioner
1-11     may grant an exception under this subsection only to districts with
1-12     the most critical need for an exception.  An exception expires at
1-13     the end of the semester for which it is granted, and the
1-14     commissioner may not grant an exception for more than one semester
1-15     at a time.
1-16           SECTION 2. This Act applies beginning with the 2001-2002
1-17     school year.
1-18           SECTION 3.  This Act takes effect immediately if it receives
1-19     a vote of two-thirds of all the members elected to each house, as
1-20     provided by Section 39, Article III, Texas Constitution.  If this
1-21     Act does not receive the vote necessary for immediate effect, this
1-22     Act takes effect September 1, 2001.
