                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to funding for group health insurance for public school
 1-3     employees.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Subchapter A, Chapter 22, Education Code, is
 1-6     amended by adding Section 22.0051 to read as follows:
 1-7           Sec. 22.0051.  PUBLIC SCHOOL EMPLOYEE HEALTH INSURANCE FUND.
 1-8     (a)  The public school employee health insurance fund is under the
 1-9     management of the board of trustees of the Teacher Retirement
1-10     System of Texas.
1-11           (b)  The public school employee health insurance fund
1-12     consists of money transferred to the fund as provided by Section
1-13     36-1, The Securities Act (Article 581-36-1, Vernon's Texas Civil
1-14     Statutes).
1-15           (c)  The Teacher Retirement System of Texas may use money in
1-16     the public school employee health insurance fund only to provide
1-17     and administer a group health insurance program for active and
1-18     retired public school employees.
1-19           SECTION 2. Section 35, The Securities Act (Article 581-35,
1-20     Vernon's Texas Civil Statutes), is amended to read as follows:
1-21           Sec. 35.  FEES. The Commissioner or Board shall charge and
1-22     collect the following fees and shall daily pay all fees received
1-23     into the State Treasury:
1-24                 A.  For the filing of any original application of a
 2-1     dealer, Seventy-five Dollars ($75.00), and for the filing of any
 2-2     renewal application of a dealer, Forty Dollars ($40.00);
 2-3                 B.  For the filing of any original application for each
 2-4     agent, officer, or salesman, Thirty-five Dollars ($35.00), and for
 2-5     the filing of any renewal application for each agent, officer, or
 2-6     salesman, Twenty Dollars ($20.00);
 2-7                 C.  For any filing to amend the registration
 2-8     certificate of a dealer or evidence of registration of a salesman,
 2-9     issue a duplicate certificate or evidence of registration, or
2-10     register a branch office, Twenty-five Dollars ($25.00);
2-11                 D.  For the filing of any original, amended or renewal
2-12     application to sell or dispose of securities, Ten Dollars ($10.00);
2-13                 E.  For the examination of any original or amended
2-14     application filed under Subsection A, B, or C of Section 7 of this
2-15     Act, regardless of whether the application is denied, abandoned,
2-16     withdrawn, or approved, a fee of two-tenths (2/10) [one-tenth
2-17     (1/10)] of one percent (1%) of the aggregate amount of securities
2-18     described and proposed to be sold to persons located within this
2-19     state based upon the price at which such securities are to be
2-20     offered to the public;
2-21                 F.  For certified copies of any papers filed in the
2-22     office of the Commissioner, the Commissioner shall charge such fees
2-23     as are reasonably related to costs;  however, in no event shall
2-24     such fees be more than those which the Secretary of State is
2-25     authorized to charge in similar cases;
2-26                 G.  For the filing of any application for approval of a
2-27     stock exchange so that securities fully listed thereon will be
 3-1     exempt, a fee of Ten Thousand Dollars ($10,000.00);
 3-2                 H.  For the filing of a request to take the Texas
 3-3     Securities Law Examination, Thirty-five Dollars ($35.00);
 3-4                 I.  For the filing of an initial notice required by the
 3-5     Commissioner to claim a secondary trading exemption, a fee of Five
 3-6     Hundred Dollars ($500.00), and for the filing of a secondary
 3-7     trading exemption renewal notice, a fee of Five Hundred Dollars
 3-8     ($500.00);
 3-9                 J.  For the filing of an initial notice required by the
3-10     Commissioner to claim a limited offering exemption, a fee of
3-11     one-tenth ( 1/10) of one percent (1%) of the aggregate amount of
3-12     securities described as being offered for sale, but in no case more
3-13     than Five Hundred Dollars ($500.00); and
3-14                 K.  For an interpretation by the Board's general
3-15     counsel of this Act or a rule adopted under this Act, a fee of One
3-16     Hundred Dollars ($100.00), except that an officer or employee of a
3-17     governmental entity and the entity that the officer or employee
3-18     represents are exempt from the fee under this subsection when the
3-19     officer or employee is conducting official business of the entity.
3-20           SECTION 3. The Securities Act (Article 581-1 et seq.,
3-21     Vernon's Texas Civil Statutes) is amended by adding Section 36-1 to
3-22     read as follows:
3-23           Sec. 36-1.  TRANSFER TO PUBLIC SCHOOL EMPLOYEE HEALTH
3-24     INSURANCE FUND. The comptroller shall transfer one-half of the fee
3-25     received under Subsection E of Section 35 of this Act to the credit
3-26     of the public school employee health insurance fund established
3-27     under Section 22.0051, Education Code.
 4-1           SECTION 4. (a)  Subsection E, Section 35, The Securities Act
 4-2     (Article 581-35, Vernon's Texas Civil Statutes), as amended by this
 4-3     Act, applies only to the fee for examination of an original or
 4-4     amended application filed under Subsection A, B, or C of Section 7,
 4-5     The Securities Act (Article 581-7, Vernon's Texas Civil Statutes),
 4-6     on or after September 1, 2001.
 4-7           (b)  A fee for examination of an original or amended
 4-8     application filed under Subsection A, B, or C of Section 7, The
 4-9     Securities Act (Article 581-7, Vernon's Texas Civil Statutes),
4-10     before September 1, 2001, is governed by the law in effect at the
4-11     time the application is filed, and the former law is continued in
4-12     effect for that purpose.
4-13           (c)  Section 36-1, The Securities Act (Article 581-36-1,
4-14     Vernon's Texas Civil Statutes), as added by this Act, applies only
4-15     to a fee under Subsection E, Section 35, The Securities Act
4-16     (Article 581-35, Vernon's Texas Civil Statutes), for examination of
4-17     an original or amended application to which Subsection (a)  of this
4-18     section applies.
4-19           SECTION 5. This Act takes effect September 1, 2001.
