A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the implementation of the state implementation plan to 1-3 meet federal ambient air quality standards. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter A, Chapter 548, Transportation Code, is 1-6 amended by adding Section 548.006 to read as follows: 1-7 Sec. 548.006. IMPLEMENTATION OF STATE IMPLEMENTATION PLAN 1-8 FOR FEDERAL AMBIENT AIR QUALITY STANDARDS. (a) The department 1-9 shall develop a comprehensive plan to accomplish inspections of 1-10 motor vehicles under this chapter in a manner that is in accordance 1-11 with the state implementation plan to meet federal ambient air 1-12 quality standards. The department shall seek and consider any 1-13 recommendations of the conservation commission in developing the 1-14 plan under this subsection. 1-15 (b) The conservation commission shall develop a 1-16 comprehensive plan to accomplish inspections of motor vehicles 1-17 under this chapter in a manner that is in accordance with the state 1-18 implementation plan to meet federal ambient air quality standards. 1-19 The plan must incorporate, to the extent that may be made 1-20 applicable, any power or duty of the conservation commission under 1-21 Chapter 382, Health and Safety Code. The conservation commission 1-22 shall seek and consider any recommendations of the department in 1-23 developing the plan under this subsection. 2-1 (c) The department and conservation commission shall adopt 2-2 joint rules for the administration of this chapter in a manner that 2-3 is in accordance with the state implementation plan to meet federal 2-4 ambient air quality standards and Chapter 382, Health and Safety 2-5 Code. 2-6 (d) The joint rules under Subsection (c) may address any 2-7 power or duty of either agency with regard to the development or 2-8 implementation of the state implementation plan to meet federal 2-9 ambient air quality standards. 2-10 (e) The department and the conservation commission shall 2-11 enter into a memorandum of understanding clarifying to the agencies 2-12 and the public the powers and duties of the agencies under this 2-13 chapter, Chapter 382, Health and Safety Code, and the state 2-14 implementation plan to meet federal ambient air quality standards. 2-15 SECTION 2. This Act takes effect September 1, 2001.
