A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to school district property values. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 403.302(c), Government Code, is amended to 1-5 read as follows: 1-6 (c) If the comptroller determines in the annual study that 1-7 the market value of property in a school district as determined by 1-8 the appraisal district that appraises property for the school 1-9 district, less the total of the amounts and values listed in 1-10 Subsection (d) as determined by that appraisal district, is valid, 1-11 the market value of property in the school district as determined 1-12 by the appraisal district that appraises property for the school 1-13 district, less the total of the amounts and values listed in 1-14 Subsection (d) as determined by that appraisal district, is 1-15 presumed to represent taxable value. In the absence of such a 1-16 presumption, taxable value is the value determined by the 1-17 comptroller under Subsection (a). Either the market value of 1-18 property for all school districts for which an appraisal district 1-19 appraises property, less the total of the amounts and values listed 1-20 in Subsection (d) for each district as determined by that appraisal 1-21 district, shall be presumed to be valid, or the taxable value for 1-22 all such school districts shall be the value determined by the 1-23 comptroller under Subsection (a). If more than one appraisal 2-1 district appraises property for a school district, the portion of 2-2 the market value of property of the school district as determined 2-3 by each appraisal district that appraises property for the school 2-4 district, less the total of the amounts and values listed in 2-5 Subsection (d), shall be presumed to be valid if the market value 2-6 of property of other school districts for which the appraisal 2-7 district appraises property, less the total of the amounts and 2-8 values listed in Subsection (d), is presumed to be valid. 2-9 SECTION 2. This Act takes effect immediately if it receives 2-10 a vote of two-thirds of all the members elected to each house, as 2-11 provided by Section 39, Article III, Texas Constitution. If this 2-12 Act does not receive the vote necessary for immediate effect, this 2-13 Act takes effect September 1, 2001.
