         Substitute the following for H.B. No. 3548:

                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the enforcement of certain zoning regulations against
 1-3     property owned by a religious organization.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 110.003, Civil Practice and Remedies Code,
 1-6     is amended by adding Subsection (d) to read as follows:
 1-7           (d)  A municipality that permits the exercise of religion or
 1-8     organized religious worship in both residential and commercial
 1-9     zoning districts may enforce, with regard to property located in
1-10     the municipality that is owned by a religious organization,
1-11     including educational and parking facilities, only the least
1-12     restrictive site development regulations applying to the least
1-13     restrictive zoning district that allows organized religious
1-14     worship.
1-15           SECTION 2. Section 211.003, Local Government Code, is amended
1-16     by adding Subsection (d) to read as follows:
1-17           (d)  The governing body of a municipality that permits the
1-18     exercise of religion or organized religious worship in both
1-19     residential and commercial zoning districts may enforce, on
1-20     property located in the municipality that is owned by a religious
1-21     organization, including educational and parking facilities, only
1-22     the least restrictive site development regulations applying to the
1-23     least restrictive zoning district that allows organized religious
1-24     worship.
 2-1           SECTION 3. This Act takes effect September 1, 2001.
