                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the regulation of property owned by public or private
 1-3     schools.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Title 7, Subtitle A, Section 211.003, Local
 1-6     Government Code, is amended by adding Subsection (d) to read as
 1-7     follows:
 1-8           (d)  A municipality that regulates the development of land
 1-9     for public and private schools shall enforce identical development
1-10     regulations throughout its corporate limits regardless of whether
1-11     the educational use is public or private.  The municipality shall
1-12     enforce the least restrictive development regulations throughout
1-13     its corporate limits on both public and private schools necessary
1-14     to achieve the compelling governmental interest in regulation of
1-15     them.
1-16           SECTION 2.  This Act takes effect September 1, 2001.
