A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the consolidation of The University of Texas System's
1-3 institutions located in the Dallas-Fort Worth area.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 51.502(1), Education Code, is amended to
1-6 read as follows:
1-7 (1) "Eligible institution" means the college,
1-8 department, or other unit of engineering at any of the following
1-9 institutions of higher education:
1-10 (A) The University of Texas at Austin;
1-11 (B) The University of Texas at Dallas
1-12 [Arlington];
1-13 (C) The University of Texas at El Paso;
1-14 (D) The University of Texas at San Antonio;
1-15 (E) The University of Texas of the Permian
1-16 Basin;
1-17 (F) Texas A&M University;
1-18 (G) Prairie View A&M University;
1-19 (H) Texas Tech University;
1-20 (I) Lamar University;
1-21 (J) University of Houston; and
1-22 (K) Texas A&M University--Kingsville.
1-23 SECTION 2. Section 54.512, Education Code, is amended to read
1-24 as follows:
2-1 Sec. 54.512. SHUTTLE BUS FEE; THE UNIVERSITY OF TEXAS AT
2-2 DALLAS CAMPUS AT ARLINGTON. (a) The board of regents of The
2-3 University of Texas System may levy a shuttle bus fee not to exceed
2-4 $10 per student for each regular semester and not to exceed $5 per
2-5 student for each term of the summer session, for the sole purpose
2-6 of financing shuttle bus service for students attending The
2-7 University of Texas at Dallas Campus at Arlington. The fees herein
2-8 authorized to be levied are in addition to any use fee or service
2-9 fee now or hereafter authorized to be levied. However, no fee may
2-10 be levied unless the fee is approved by a majority vote of those
2-11 students participating in a general election called for that
2-12 purpose.
2-13 (b) Such fees shall be deposited to an account known as "The
2-14 University of Texas at Dallas Arlington Campus Shuttle Bus Fee
2-15 Account" and shall be expended in accordance with a budget
2-16 submitted to and approved by the board of regents. The board of
2-17 regents shall make such changes in the budget as it deems necessary
2-18 before approving the budget, and shall then levy the fees, within
2-19 the limits herein fixed, in such amounts as will be sufficient to
2-20 meet the budget as approved.
2-21 SECTION 3. Section 54.5121, Education Code, is amended to
2-22 read as follows:
2-23 Sec. 54.5121. INTERCOLLEGIATE ATHLETIC FEE; THE UNIVERSITY
2-24 OF TEXAS AT DALLAS CAMPUS AT ARLINGTON. (a) The board of regents
2-25 of The University of Texas System may impose a mandatory
2-26 intercollegiate athletics fee at The University of Texas at Dallas
2-27 Campus at Arlington. The amount of the fee may not exceed $7.75 per
3-1 semester credit hour for each regular semester, unless increased as
3-2 provided by Subsection (b). The fee may not be imposed unless
3-3 approved by a majority vote of the students participating in a
3-4 general student election held for that purpose.
3-5 (b) The amount of the fee per semester credit hour may be
3-6 increased from one academic year to the next only if approved by a
3-7 majority vote of the students participating in a general student
3-8 election held for that purpose or, if the amount of the increase
3-9 does not exceed five percent, by the legislative body of the
3-10 student government of the university.
3-11 (c) The board of regents may prorate the amount of the fee
3-12 for a summer session.
3-13 (d) The fee imposed under this section may not be considered
3-14 in determining the maximum student services fees that may be
3-15 imposed under Section 54.503.
3-16 SECTION 4. Section 55.1722, Education Code, is amended by
3-17 amending Subsection (a) and adding Subsection (e) to read as
3-18 follows:
3-19 (a) In addition to the other authority granted by this
3-20 subchapter, the board of regents of The University of Texas System
3-21 may acquire, purchase, construct, improve, renovate, enlarge, or
3-22 equip property, buildings, structures, facilities, roads, or
3-23 related infrastructure for the following institutions to be
3-24 financed by the issuance of bonds in accordance with this
3-25 subchapter, including bonds issued in accordance with its
3-26 systemwide revenue financing program and secured as provided by
3-27 that program in aggregate principal amounts not to exceed the
4-1 following amounts:
4-2 (1) [The University of Texas at Arlington, $16
4-3 million;]
4-4 [(2)] The University of Texas at Austin, $12.5
4-5 million;
4-6 (2) [(3)] The University of Texas at Brownsville,
4-7 $22.5 million;

5-2 considered to be bonds issued for facilities of The University of
5-3 Texas at Dallas.
5-4 SECTION 5. Sections 61.003(3) and (5), Education Code, are
5-5 amended to read as follows:
5-6 (3) "General academic teaching institution" means The
5-7 University of Texas at Austin; The University of Texas at El Paso;
5-8 The University of Texas of the Permian Basin; The University of
5-9 Texas at Dallas; The University of Texas at San Antonio; Texas
5-10 A&M University, Main University; [The University of Texas at
5-11 Arlington;] Tarleton State University; Prairie View A&M

6-11 SECTION 6. Section 63.002(c), Education Code, is amended to
6-12 read as follows:
6-13 (c) The amount available for distribution from the fund may
6-14 be appropriated only for programs that benefit medical research,
6-15 health education, or treatment programs at the following
6-16 health-related institutions of higher education:

11-27 SECTION 9. Chapter 70, Education Code, is amended to read as
12-1 follows:
12-2 CHAPTER 70. THE UNIVERSITY OF TEXAS AT DALLAS
12-3 Sec. 70.01. UNIVERSITY AUTHORIZED. The Board of Regents of
12-4 The University of Texas System shall establish and maintain a
12-5 state-supported general academic teaching institution of higher
12-6 education with campuses located in Dallas and Arlington to be known
12-7 as The University of Texas at Dallas. The university may maintain
12-8 a medical branch in Dallas to be known as the Southwestern Medical
12-9 Center of The University of Texas at Dallas.
12-10 Sec. 70.02. [LOCATION. The board shall locate The University
12-11 of Texas at Dallas on a site, to be selected in Dallas County,
12-12 consisting of not less than 250 acres of land that shall be donated
12-13 for that purpose without cost to the State of Texas. The site may
12-14 extend into any county adjacent to Dallas County.]
12-15 [Sec. 70.03.] COURSES AND DEGREES. (a) The board may
12-16 prescribe courses leading to customary degrees offered at leading
12-17 American universities and may award those degrees. It is the
12-18 intent of the legislature that those degrees include bachelor's,
12-19 master's, and doctor's degrees, and their equivalents.
12-20 (b) No department, school, or degree program shall be
12-21 instituted except with the prior approval of the Coordinating
12-22 Board, Texas College and University System, or its successor.
12-23 [(c) Initial programs and departments shall be limited to
12-24 those which existed in the Southwest Center for Advanced Studies on
12-25 September 1, 1969. Approval of these programs, their expansion,
12-26 and initiation of other programs shall be recommended by the board
12-27 of regents and approved by the coordinating board.]
13-1 Sec. 70.03 [70.04]. RULES AND REGULATIONS; JOINT
13-2 APPOINTMENTS. The board may adopt [other] rules [and regulations]
13-3 for the operation, control, and management of the university that
13-4 are necessary for the conduct of the university as one of the first
13-5 class. The board is specifically authorized to make joint
13-6 appointments in the university and in other institutions under its
13-7 governance. The salary of any person who receives a joint
13-8 appointment shall be apportioned to the appointing institutions on
13-9 the basis of services rendered.
13-10 Sec. 70.04 [70.05]. PROGRAMS AT OTHER UNIVERSITIES. It is
13-11 the intent of the legislature that existing programs leading to
13-12 undergraduate and graduate degrees at the University of North
13-13 Texas, Texas Woman's University, and Texas A&M University--Commerce
13-14 [East Texas State University, and The University of Texas at
13-15 Arlington] shall never be placed at a disadvantage, curtailed, or
13-16 restricted from orderly and proper expansion for any cause
13-17 attributable to the establishment of, or the curricular objectives
13-18 for, The University of Texas at Dallas; and that these universities
13-19 shall not, as a result of the establishment of The University of
13-20 Texas at Dallas, be handicapped in realizing their full potentials
13-21 in quantity or quality for developing additional undergraduate and
13-22 graduate programs which may from time to time be authorized by the
13-23 coordinating board.
13-24 Sec. 70.05 [70.07]. GRANTS AND GIFTS. The board may accept
13-25 and administer, on terms and conditions satisfactory to it, grants
13-26 or gifts of property, including real estate or money, that may be
13-27 tendered to it in aid of the planning, establishment, conduct, and
14-1 operation of The University of Texas at Dallas, and in aid of the
14-2 research and teaching at the university. The board may accept from
14-3 the federal government or any foundation, trust fund, corporation,
14-4 or individual donations, gifts, and grants, including real estate,
14-5 buildings, libraries, laboratories, apparatus, equipment, records,
14-6 leases, or money for the use and benefit of the university. Before
14-7 acceptance of gifts, grants, and donations of real property, the
14-8 board shall secure the opinion of the attorney general on the title
14-9 of the real property to be conveyed.
14-10 Sec. 70.06. LEASE OF LAND FOR HOSPITAL, ETC. (a) The board
14-11 may lease to nonprofit charitable, scientific, or educational
14-12 corporations organized under the laws of this state, or to any
14-13 governmental agency or agencies, a tract or tracts of land situated
14-14 in Dallas County out of land previously deeded by Southwestern
14-15 Medical Foundation to the State of Texas.
14-16 (b) A lease under this section shall be on the terms,
14-17 conditions, and provisions and for a period of years determined by
14-18 the board. No lease shall be for a term of more than 99 years.
14-19 (c) A lease under this section shall be made only to a
14-20 nonprofit corporation or governmental agency for the purpose of
14-21 constructing, maintaining, and operating a hospital, hospitals, or
14-22 public health centers and services, or for the purpose of
14-23 constructing, maintaining, and operating dormitories and housing
14-24 facilities for students attending the medical school or persons
14-25 employed by and in institutions located on the property.
14-26 (d) In no event shall the State of Texas or The University
14-27 of Texas System be liable, directly or indirectly, for any expense
15-1 or cost in connection with the construction, operation, and
15-2 maintenance of any building or other improvement placed on the
15-3 leased premises by any lessee.
15-4 [Sec. 70.08. UNDERGRADUATE ADMISSIONS. (a) The board of
15-5 regents of The University of Texas System may provide for the
15-6 admission and enrollment of not more than 2,000 entering freshman
15-7 students at The University of Texas at Dallas.]
15-8 [(b) The board may provide for the admission of
15-9 undergraduate transfer students with less than 54 semester hours of
15-10 college credit at The University of Texas at Dallas as provided by
15-11 this section. The board shall control the admission and enrollment
15-12 of entering freshmen and of undergraduate transfer students with
15-13 less than 54 semester hours of college credit in a manner that
15-14 ensures that the enrollment of students classified as freshmen and
15-15 sophomores at the institution does not exceed 5,000, except as
15-16 provided by Subsection (c) of this section.]
15-17 [(c) For each academic year, in addition to the enrollments
15-18 targeted by the academic plan for that academic year, The
15-19 University of Texas at Dallas may admit an additional number of
15-20 students equal to not more than four percent of the targeted number
15-21 if those students are classified as sophomores, have earned more
15-22 than 29 but less than 54 semester hours of college credit at a
15-23 community college in the Dallas or the Collin County Community
15-24 College district, and otherwise meet the minimum criteria for
15-25 transfer admission to The University of Texas at Dallas. This
15-26 subsection does not limit or otherwise affect the enrollment of
15-27 students at The University of Texas at Dallas who have earned
16-1 semester credit hours at a community college in the Dallas or the
16-2 Collin County Community College district and who otherwise compete
16-3 successfully for admission and enrollment at The University of
16-4 Texas at Dallas.]
16-5 [(d) It is the intent of the legislature that minority
16-6 students be full participants in the educational opportunities
16-7 created by the admission of lower-division undergraduate students
16-8 to The University of Texas at Dallas primarily in programs leading
16-9 to degrees in natural sciences, mathematics, and engineering.
16-10 Therefore, until the minority student populations at The University
16-11 of Texas at Dallas are fully representative of the state's minority
16-12 populations, the board shall cause to be set aside for each
16-13 academic year from among the enrollments targeted by the academic
16-14 plan for that academic year a number of enrollments equal to not
16-15 less than five percent of the targeted number, and those
16-16 enrollments are to be reserved exclusively for admission of
16-17 minority students.]
16-18 [(e) The board shall develop policies for undergraduate
16-19 admission to The University of Texas at Dallas that emphasize the
16-20 admission and enrollment of lower-division students who intend to
16-21 enroll in academic programs leading to degrees in natural sciences,
16-22 mathematics, or engineering. Nothing in this section prohibits a
16-23 public senior college or university in the North Texas region from
16-24 creating and developing undergraduate and graduate programs in the
16-25 areas of natural sciences, mathematics, and engineering.]
16-26 [(f) At a minimum, in addition to other qualitative criteria
16-27 that the board may establish, the board shall provide that the
17-1 admission criteria for entering freshmen and for transfer students
17-2 with less than 54 semester hours of college credit be no less
17-3 stringent than the criteria for admission to The University of
17-4 Texas at Austin for those students.]
17-5 [(g) The board shall continue to provide for the admission
17-6 at The University of Texas at Dallas of undergraduate transfer
17-7 students with 54 or more semester hours of college credit. The
17-8 admission criteria effective on March 1, 1989, for those students
17-9 may continue in effect but may be amended from time to time by the
17-10 board. In amending those criteria, the board shall consider that
17-11 one of the primary missions of The University of Texas at Dallas is
17-12 to serve those students who have received freshman-level and
17-13 sophomore-level undergraduate instruction at community colleges
17-14 located in the surrounding area.]
17-15 [(h) This section does not affect the criteria for admission
17-16 to graduate programs at The University of Texas at Dallas.]
17-17 [(i) In this section, the number of students is determined
17-18 by head count.]
17-19 SECTION 10. Section 151.002(a), Education Code, as added by
17-20 Chapter 1381, Acts of the 76th Legislature, Regular Session, 1999,
17-21 is amended to read as follows:
17-22 (a) The council shall establish a consortium of Alzheimer's
17-23 disease centers, to be initially composed of the Alzheimer's
17-24 disease centers at the Baylor College of Medicine, the Texas Tech
17-25 University Health Sciences Center, the University of North Texas
17-26 Health Science Center at Fort Worth, and the [The University of
17-27 Texas] Southwestern Medical Center of The University of Texas at
18-1 Dallas. The council may add additional consortium participants to
18-2 the consortium as necessary.
18-3 SECTION 11. Section 572.003(c), Government Code, is amended
18-4 to read as follows:
18-5 (c) The term means a member of:
18-6 (1) the Public Utility Commission of Texas;

20-17 SECTION 12. Section 121.102, Health and Safety Code, is
20-18 amended to read as follows:
20-19 Sec. 121.102. CONSORTIUM ESTABLISHED. Subject to
20-20 availability of funds, the department shall establish a public
20-21 health consortium composed of:
20-22 (1) The University of Texas Health Science Center at
20-23 San Antonio;
20-24 (2) The University of Texas M. D. Anderson Cancer
20-25 Center;
20-26 (3) the [The University of Texas] Southwestern Medical
20-27 Center of The University of Texas at Dallas;
21-1 (4) The University of Texas Medical Branch at
21-2 Galveston;
21-3 (5) The University of Texas Health Science Center at
21-4 Houston;
21-5 (6) The University of Texas Health Science Center at
21-6 Tyler;
21-7 (7) the Texas Tech University Health Sciences Center;

21-11 (10) any other public institution of higher education
21-12 that elects to participate in the consortium.
21-13 SECTION 13. Section 777.008(b), Health and Safety Code, is
21-14 amended to read as follows:
21-15 (b) The committee is composed of one public member appointed
21-16 by the Texas Board of Health, one public member appointed by the
21-17 Advisory Commission on State Emergency Communications, and 13
21-18 members appointed by the chief executive officer of each of the
21-19 following entities:
21-20 (1) The University of Texas Medical Branch at
21-21 Galveston;
21-22 (2) the Dallas County Hospital District/North Texas
21-23 Poison Center;

22-14 SECTION 14. Sections 1, 2, and 4, Chapter 113, Acts of the
22-15 57th Legislature, Regular Session, 1961 (Article 2603j, Vernon's
22-16 Texas Civil Statutes), are amended to read as follows:
22-17 Sec. 1. The Board of Regents of The University of Texas is
22-18 hereby authorized and empowered to trade and exchange not more than
22-19 ten (10) acres of land on the western corner of the campus of the
22-20 [The University of Texas] Southwestern Medical School of The
22-21 University of Texas at [in] Dallas[, Texas], being bound on the
22-22 north by Inwood Road and on the south by the right-of-way of the
22-23 Chicago, Rock Island, and Gulf Railway, the same being in the Wm.
22-24 B. Coats Survey, Abstract No. 236, Dallas County, Texas, for a
22-25 tract of land of seven and one-half (7 1/2) acres, more or less,
22-26 belonging to the Dallas County Hospital District, adjacent to the
22-27 Parkland Memorial Hospital, Dallas, Texas, the same being in the A.
23-1 Bahn Survey, Abstract No. 182, and/or the Wm. B. Coats Survey,
23-2 Abstract No. 236, Dallas County, Texas, and to accomplish such
23-3 trade and exchange the Board of Regents of The University of Texas
23-4 is authorized and directed to convey on behalf of the State of
23-5 Texas the ten (10) acre tract of land heretofore described in this
23-6 Section to the Dallas County Hospital District, owner of the seven
23-7 and one-half (7 1/2) acre tract above described, upon the execution
23-8 and delivery of a good and sufficient deed of conveyance from the
23-9 Dallas County Hospital District to the State of Texas for the use
23-10 and benefit of the Board of Regents of The University of Texas of
23-11 the seven and one-half (7 1/2) acre tract.
23-12 Sec. 2. The Board of Regents of The University of Texas on
23-13 behalf of the State of Texas is hereby authorized and empowered to
23-14 convey the seven and one-half (7 1/2) acre tract received in
23-15 exchange from the Dallas County Hospital District to the governing
23-16 board of the Children's Medical Center of Dallas, Dallas County,
23-17 Texas, for a construction site of a children's hospital in
23-18 consideration of the same being made available as a full-time
23-19 teaching facility for the [The University of Texas] Southwestern
23-20 Medical School of The University of Texas at [in] Dallas[, Texas];
23-21 provided, however, that neither the [The University of Texas]
23-22 Southwestern Medical School of The University of Texas at Dallas
23-23 nor the Board of Regents of The University of Texas shall ever
23-24 incur any financial obligation or expend any funds appropriated by
23-25 the Legislature for the construction, maintenance, or operation of
23-26 such children's hospital.
23-27 Sec. 4. Each deed to be executed as provided for in this Act
24-1 shall contain by reference any and all easements, reversions, and
24-2 restrictions to which any tract or tracts conveyed by any party is
24-3 subject or agreed upon; provided, however, that no deeds shall be
24-4 exchanged until a contract is negotiated and executed between the
24-5 Board of Regents of The University of Texas and the governing board
24-6 of the Children's Medical Center of Dallas which shall obligate the
24-7 governing board of the Children's Medical Center to construct and
24-8 operate a children's hospital as a teaching hospital fully
24-9 integrated with the medical program of the [The University of
24-10 Texas] Southwestern Medical School of The University of Texas at
24-11 Dallas, without cost to the State of Texas and which contract shall
24-12 contain such other terms and conditions as the Board of Regents of
24-13 The University of Texas shall deem reasonable.
24-14 SECTION 15. Sections 54.529, 68.01-68.03, 68.06, and
24-15 74.101-74.105, Education Code, are repealed.
24-16 SECTION 16. (a) This Act takes effect September 1, 2001.
24-17 (b) The board of regents of The University of Texas System
24-18 shall provide for the orderly implementation of this Act and may
24-19 take all action necessary for that purpose.
