                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to rates paid to certain providers of health care and to
 1-3     making appropriations for such payments from the economic
 1-4     stabilization fund.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1. The following money is appropriated from the
 1-7     economic stabilization fund for the state fiscal biennium ending
 1-8     August 31, 2003:
 1-9                 (1)  $100 million for each year of the biennium to the
1-10     Texas Department of Human Services to use to increase rate payments
1-11     to enhance the quality of care provided by, and to increase the
1-12     number of available, health care providers of the following types:
1-13                       (A)  nursing homes;
1-14                       (B)  intermediate care facilities for the
1-15     mentally retarded; and
1-16                       (C)  home health care providers; and
1-17                 (2)  $25 million for each year of the biennium to the
1-18     Texas Department of Mental Health and Mental Retardation to use to
1-19     increase rate payments to enhance the quality of care provided by,
1-20     and to increase the number of available, health care providers of
1-21     the following types:
1-22                       (A)  nursing homes;
1-23                       (B)  intermediate care facilities for the
 2-1     mentally retarded; and
 2-2                       (C)  home health care providers.
 2-3           SECTION 2. The Texas Department of Human Services and the
 2-4     Texas Department of Mental Health and Mental Retardation shall
 2-5     adopt rules regarding the determination of rates to be paid to
 2-6     health care providers listed in Section 1 of this Act to promote
 2-7     the quality of care being provided and to increase the number of
 2-8     available providers.
 2-9           SECTION 3. This Act takes effect September 1, 2001.
