                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to implementation of policies requiring successful
 1-3     performance on assessment instruments for advancement to certain
 1-4     grade levels in public schools.
 1-5           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-6           SECTION 1.  Section 28.0211, Education Code, is amended by
 1-7     amending Subsections (n) and (o) and adding Subsections (p) and (q)
 1-8     to read as follows:
 1-9           (n)  This section applies to the assessment instrument
1-10     administered to students in:
1-11                 (1)  the third grade beginning with the 2003-2004
1-12     [2002-2003] school year;
1-13                 (2)  the fifth grade beginning with the 2005-2006
1-14     [2004-2005] school year; and
1-15                 (3)  the eighth grade beginning with the 2008-2009
1-16     [2007-2008] school year.
1-17           (o)  Subsection (n) and this subsection expire September 1,
1-18     2009 [January 1, 2008].
1-19           (p)  The admission, review, and dismissal committee of a
1-20     student in third, fifth, or eighth grade who participates in a
1-21     district's special education program under Subchapter B, Chapter
1-22     29, and who does not perform satisfactorily on an assessment
1-23     instrument specified under Subsection (a) and administered under
1-24     Section 39.023(a) or (b) shall determine the manner in which the
 2-1     student will participate in an accelerated instruction program
 2-2     under this section based on the schedule prescribed by this
 2-3     subsection for providing accelerated instruction to students who do
 2-4     not participate in a district's special education program.
 2-5     Notwithstanding Subsection (n), Subsections (b), (c), (f), (j), and
 2-6     (k) apply to students in:
 2-7                 (1)  the third grade beginning with the 2002-2003
 2-8     school year;
 2-9                 (2)  the  fifth grade beginning with the 2004-2005
2-10     school year; and
2-11                 (3)  the eighth grade beginning with the 2007-2008
2-12     school year.
2-13           (q)  Subsection (p) and this subsection expire September 1,
2-14     2008.
2-15           SECTION 2.  This Act takes effect September 1, 2001.
