                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the expansion of the boundaries and the number of
 1-3     members of the board of the Upper Kirby Management District.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 376.154(a), Local Government Code, is
 1-6     amended to read as follows:
 1-7           (a)  The district includes all the territory contained within
 1-8     the following described area:
 1-9           Beginning at a point at the intersection of the north
1-10     right-of-way line of U.S. Highway 59 and the west right-of-way line
1-11     of Buffalo Speedway;
1-12           THENCE in a northerly direction along the west right-of-way
1-13     line of Buffalo Speedway to the south right-of-way line of Richmond
1-14     Avenue;
1-15           THENCE in a westerly direction along the south right-of-way
1-16     line of Richmond Avenue to the east right-of-way line of the
1-17     Southern Pacific railroad;
1-18           THENCE in a northerly direction along the east right-of-way
1-19     line of the Southern Pacific Railroad to the north right-of-way
1-20     line of Richmond Avenue;
1-21           THENCE in an easterly direction along the north right-of-way
1-22     line of Richmond Avenue to the west right-of-way line of Buffalo
1-23     Speedway;
1-24           THENCE in a northerly direction along the west right-of-way
 2-1     line of Buffalo Speedway to the south right-of-way line of
 2-2     Wickersham Lane;
 2-3           THENCE in a easterly direction to the east right-of-way line
 2-4     of buffalo Speedway, said point also being the northwest corner
 2-5     property line of Lot 10, Block 66 of the River Oaks, Section 7
 2-6     subdivision;
 2-7           THENCE in an easterly direction along the north property line
 2-8     of Lot 10, Block 66 of the River Oaks, Section 7 subdivision to the

64-15          SECTION 2. Section 376.158(a), Local Government Code, is
64-16    amended to read as follows:
64-17          (a)  The district is governed by a board of nine [five]
64-18    directors who serve staggered four-year terms.
64-19          SECTION 3. Section 376.159, Local Government Code, is amended
64-20    to read as follows:
64-21          Sec. 376.159.  APPOINTMENT OF DIRECTORS; VACANCY.  (a)
64-22    Directors shall be appointed and qualify in the manner provided by
64-23    Subchapter D, Chapter 375.  A vacancy in the office of director
64-24    because of the death, resignation, or removal of a director shall
64-25    be filled by the remaining members of the board by appointing a
64-26    qualified person for the unexpired term.
64-27          (b)  The board may increase the number of directors by
 65-1    resolution if a majority of the directors finds that increasing the
 65-2    number of directors is in the best interest of the district.
 65-3          SECTION 4. (a)  Notwithstanding Section 376.159, Local
 65-4    Government Code, as amended by this Act, the following persons are
 65-5    appointed to the board of the Upper Kirby Management District to
 65-6    fill the following positions:
 65-7                (1)  Judy Penner, position six;
 65-8                (2)  Tom Lippincott, position seven;
 65-9                (3)  Jay Baker, position eight; and
65-10                (4)  Al Keller, position nine.
65-11          (b)  Of the new positions, the directors filling positions
65-12    six and seven serve until June 1, 2003, and the directors filling
65-13    positions eight and nine serve until June 1, 2005.
65-14          (c)  This section expires September 1, 2005.
65-15          SECTION 5. This Act takes effect September 1, 2001.
