 1-7     COMMITTEE AMENDMENT NO. 1                              By:  Lindsay
 1-8           Amend H.B. 3639 (house engrossment) as follows:
 1-9           (1)  In SECTION 2 of the bill, strike amended Section
1-10     376.158(a), Local Government Code (page 26, lines 40-41), and
1-11     substitute the following:
1-12           (a)  Except as provided by this subsection, the [The]
1-13     district is governed by a board of five directors.  Directors [who]
1-14     serve staggered four-year terms.  The board by resolution may
1-15     increase or decrease the number of directors to not more than nine
1-16     and not fewer than five directors on a finding by a majority of the
1-17     board that the change in the number of directors is in the best
1-18     interest of the district.
1-19           (2)  In SECTION 3 of the bill, strike added Section
1-20     376.159(b), Local Government Code (page 26, lines 50-52), and
1-21     substitute the following:
1-22           (b)  The existing board shall appoint qualified persons to
1-23     fill any new positions on the board created by an increase in the
1-24     number of directors under Section 376.158(a) and shall provide for
1-25     staggering the terms of directors serving in the new positions.  On
1-26     the expiration of the term of a director appointed under this
1-27     subsection, a succeeding director shall be appointed and qualify as
1-28     provided by Subsection (a).
1-29           (3)  Strike Subsections (a) and (b) of SECTION 4 of the bill
1-30     (page 26, lines 53-63) and substitute the following:
1-31     (a)  Notwithstanding Section 376.159, Local Government Code, as
1-32     amended by this Act, the following persons are appointed or
1-33     reappointed to the board of the Upper Kirby Management District to
1-34     fill the following positions:
1-35                 (1)  Robert Axelson, position one;
1-36                 (2)  Sharlet Matak, position two;
1-37                 (3)  W. T. Dickey, position three;
1-38                 (4)  Morris B. Penner, position four; and
1-39                 (5)  Robert H. Schultz, position five.
1-40           (b)  Notwithstanding Section 376.158(a), Local Government
1-41     Code, as amended by this Act, the directors filling positions one
1-42     and two serve until June 1, 2003, and the directors filling
1-43     positions three, four, and five serve until June 1, 2005.

1-46     relating to the expansion of the boundaries and the number of
1-47     members of the board of the Upper Kirby Management District.
1-48           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-49           SECTION 1. Section 376.154(a), Local Government Code, is
1-50     amended to read as follows:
1-51           (a)  The district includes all the territory contained within
1-52     the following described area:
1-53           Beginning at a point at the intersection of the north
1-54     right-of-way line of U.S. Highway 59 and the west right-of-way line
1-55     of Buffalo Speedway;
1-56           THENCE in a northerly direction along the west right-of-way
1-57     line of Buffalo Speedway to the south right-of-way line of Richmond
1-58     Avenue;
1-59           THENCE in a westerly direction along the south right-of-way
1-60     line of Richmond Avenue to the east right-of-way line of the
1-61     Southern Pacific railroad;
1-62           THENCE in a northerly direction along the east right-of-way
1-63     line of the Southern Pacific Railroad to the north right-of-way
 2-1     line of Richmond Avenue;
 2-2           THENCE in an easterly direction along the north right-of-way
 2-3     line of Richmond Avenue to the west right-of-way line of Buffalo

26-38          SECTION 2. Section 376.158(a), Local Government Code, is
26-39    amended to read as follows:
26-40          (a)  The district is governed by a board of nine [five]
26-41    directors who serve staggered four-year terms.
26-42          SECTION 3. Section 376.159, Local Government Code, is amended
26-43    to read as follows:
26-44          Sec. 376.159.  APPOINTMENT OF DIRECTORS; VACANCY.  (a)
26-45    Directors shall be appointed and qualify in the manner provided by
26-46    Subchapter D, Chapter 375.  A vacancy in the office of director
26-47    because of the death, resignation, or removal of a director shall
26-48    be filled by the remaining members of the board by appointing a
26-49    qualified person for the unexpired term.
26-50          (b)  The board may increase the number of directors by
26-51    resolution if a majority of the directors finds that increasing the
26-52    number of directors is in the best interest of the district.
26-53          SECTION 4. (a)  Notwithstanding Section 376.159, Local
26-54    Government Code, as amended by this Act, the following persons are
26-55    appointed to the board of the Upper Kirby Management District to
26-56    fill the following positions:
26-57                (1)  Judy Penner, position six;
26-58                (2)  Tom Lippincott, position seven;
26-59                (3)  Jay Baker, position eight; and
26-60                (4)  Al Keller, position nine.
26-61          (b)  Of the new positions, the directors filling positions
26-62    six and seven serve until June 1, 2003, and the directors filling
26-63    positions eight and nine serve until June 1, 2005.
26-64          (c)  This section expires September 1, 2005.
26-65          SECTION 5. This Act takes effect September 1, 2001.
