 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the election and qualifications of directors of the
 1-9     Lubbock County Water Control and Improvement District No. 1.
1-10           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11           SECTION 1. Sections 3.1 and 3.2, Chapter 1149, Acts of the
1-12     71st Legislature, Regular Session, 1989, are amended to read as
1-13     follows:
1-14           Sec. 3.1. (a)  The district's powers shall be exercised by a
1-15     board of five directors.  One director shall be elected from each
1-16     commissioners precinct in Lubbock County, and one director shall be
1-17     elected from the district at large.
1-18           (b)  To serve as director from a commissioners precinct, a
1-19     director must be a resident of that precinct, and to serve as
1-20     director at large, the director must be a resident of Lubbock
1-21     County.
1-22           (c)  On the first Saturday in May 2002, an election shall be
1-23     held in the district to elect five directors.  Directors elected
1-24     from commissioners precincts 1 and 3 shall serve two-year terms,
1-25     and directors elected from commissioners precincts 2 and 4 and from
1-26     the district at large shall serve four-year terms.
1-27           (d)  Until the initial board of directors is elected under
1-28     Subsection (c) of this section and has qualified, the persons
1-29     serving as directors of the district on September 1, 2001, shall
1-30     continue to serve as directors of the district.
1-31           (e)  After the election held under Subsection (c) of this
1-32     section, an election shall be held on the first Saturday in May of
1-33     each even-numbered year to elect directors to the appropriate
1-34     positions on the board.  [Each of the directors serving on the
1-35     effective date of this Act shall serve for the term for which he
1-36     was elected.  Subsequent directors shall be elected as provided by
1-37     Chapter 51, Water Code, and the Election Code.]
1-38           Sec. 3.2. Except as  provided by Section 3.1(c) of this Act,
1-39     [The] directors are elected [at large from within the district] for
1-40     four-year staggered [four year] terms.
1-41           SECTION 2. (a)  The proper and legal notice of the intention
1-42     to introduce this Act, setting forth the general substance of this
1-43     Act, has been published as provided by law, and the notice and a
1-44     copy of this Act have been furnished to all persons, agencies,
1-45     officials, or entities to which they are required to be furnished
1-46     by the constitution and other laws of this state, including the
1-47     governor, who has submitted the notice and Act to the Texas Natural
1-48     Resource Conservation Commission.
1-49           (b)  The Texas Natural Resource Conservation Commission has
1-50     filed its recommendations relating to this Act with the governor,
1-51     lieutenant governor, and speaker of the house of representatives
1-52     within the required time.
1-53           (c)  All requirements of the constitution and laws of this
1-54     state and the rules and procedures of the legislature with respect
1-55     to the notice, introduction, and passage of this Act are fulfilled
1-56     and accomplished.
1-57           SECTION 3.  This Act takes effect September 1, 2001.
