                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the board of directors and the taxing authority of the
 1-3     Collingsworth County Underground Water Conservation District.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1. Section 10, Chapter 376, Acts of the 69th
 1-6     Legislature, Regular Session, 1985, is amended to read as follows:
 1-7           Sec. 10.  TAXES AND BONDS.  The tax and bond provisions of
 1-8     Chapter 36 [Chapters 51 and 52], Water Code, apply to the district.
 1-9     The district may call an election under Chapter 36, Water Code, to
1-10     approve the levy and collection of:
1-11                 (1)  an ad valorem tax to secure bonds issued by the
1-12     district; or
1-13                 (2)  a maintenance and operation tax.
1-14           SECTION 2.  Section 12, Chapter 376, Acts of the 69th
1-15     Legislature, Regular Session, 1985, is amended to read as follows:
1-16           Sec. 12.  ANNEXATION. Additional territory may be added to
1-17     the district as provided by Chapter 49 [51], Water Code.  If the
1-18     district annexes additional territory, the board of directors may
1-19     add the annexed territory to one or more existing single-member
1-20     districts for purposes of electing directors, may redraw the five
1-21     single-member districts to include the annexed territory, or may
1-22     add a sixth single-member district for the election of an
1-23     additional director.  [The board of directors shall determine to
1-24     which precinct the annexed land will be added for purposes of
 2-1     election of directors.]
 2-2           SECTION 3. Section 13(c), Chapter 376, Acts of the 69th
 2-3     Legislature, Regular Session, 1985, is amended to read as follows:
 2-4           (c)  One director shall be elected from each single-member
 2-5     district [county commissioners precinct in Collingsworth County and
 2-6     one director shall be elected from the district at large].  To
 2-7     represent a single-member district [commissioners precinct], the
 2-8     director must own property in that single-member district [be a
 2-9     resident of the precinct].
2-10           SECTION 4. Section 13(e), Chapter 376, Acts of the 69th
2-11     Legislature, Regular Session, 1985, is amended to read as follows:
2-12           (e)  The board of directors shall draw five numbered
2-13     single-member districts for electing directors and may revise the
2-14     districts as necessary or appropriate.  For the conduct of an
2-15     election under this section, the board shall provide for one
2-16     director to be elected from each of the single-member districts.  A
2-17     director elected from a single-member district represents the
2-18     residents and property owners of that single-member district.
2-19     Board elections shall be held on a uniform election day in
2-20     even-numbered years and shall be conducted according to Sections
2-21     36.017(b)-(h), Water Code, and the Election Code. [After the
2-22     election of directors at the confirmation election held under
2-23     Section 9 of this Act, regular elections for a portion of the board
2-24     of directors shall be held in each even-numbered year.  The
2-25     directors elected from commissioners precincts 1 and 3 and the
2-26     director elected at large at the confirmation election shall serve
2-27     as directors until the first regular meeting of the board after the
 3-1     second regular election of directors, and the directors elected
 3-2     from commissioners precincts 2 and 4 at the confirmation election
 3-3     shall serve until the first regular meeting of the board after the
 3-4     first regular election of directors.]
 3-5           SECTION 5. (a)  A director of the Collingsworth County
 3-6     Underground Water Conservation District who is serving on the day
 3-7     before the effective date of this Act shall serve until the
 3-8     director's term expires.
 3-9           (b)  At the 2002 directors' election, the open  board
3-10     positions shall be filled by the appropriate number of directors,
3-11     who shall be elected from single-member districts.
3-12           (c)  At the 2004 directors' election, the remaining board
3-13     positions shall be filled by directors elected from the remaining
3-14     single-member districts.
3-15           (d)  At each subsequent directors' election, the appropriate
3-16     number of directors shall be elected from single-member districts.
3-17           SECTION 6.  This Act takes effect immediately if it receives
3-18     a vote of two-thirds of all the members elected to each house, as
3-19     provided by Section 39, Article III, Texas Constitution.  If this
3-20     Act does not receive the vote necessary for immediate effect, this
3-21     Act takes effect September 1, 2001.
