1-6 A BILL TO BE ENTITLED
1-7 AN ACT
1-8 relating to the board of directors and the taxing authority of the
1-9 Collingsworth County Underground Water Conservation District.
1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-11 SECTION 1. Section 10, Chapter 376, Acts of the 69th
1-12 Legislature, Regular Session, 1985, is amended to read as follows:
1-13 Sec. 10. TAXES AND BONDS. The tax and bond provisions of
1-14 Chapter 36 [Chapters 51 and 52], Water Code, apply to the district.
1-15 The district may call an election under Chapter 36, Water Code, to
1-16 approve the levy and collection of:
1-17 (1) an ad valorem tax to secure bonds issued by the
1-18 district; or
1-19 (2) a maintenance and operation tax.
1-20 SECTION 2. Section 12, Chapter 376, Acts of the 69th
1-21 Legislature, Regular Session, 1985, is amended to read as follows:
1-22 Sec. 12. ANNEXATION. Additional territory may be added to
1-23 the district as provided by Chapter 49 [51], Water Code. If the
1-24 district annexes additional territory, the board of directors may
1-25 add the annexed territory to one or more existing single-member
1-26 districts for purposes of electing directors, may redraw the five
1-27 single-member districts to include the annexed territory, or may
1-28 add a sixth single-member district for the election of an
1-29 additional director. [The board of directors shall determine to
1-30 which precinct the annexed land will be added for purposes of
1-31 election of directors.]
1-32 SECTION 3. Section 13(c), Chapter 376, Acts of the 69th
1-33 Legislature, Regular Session, 1985, is amended to read as follows:
1-34 (c) One director shall be elected from each single-member
1-35 district [county commissioners precinct in Collingsworth County and
1-36 one director shall be elected from the district at large]. To
1-37 represent a single-member district [commissioners precinct], the
1-38 director must own property in that single-member district [be a
1-39 resident of the precinct].
1-40 SECTION 4. Section 13(e), Chapter 376, Acts of the 69th
1-41 Legislature, Regular Session, 1985, is amended to read as follows:
1-42 (e) The board of directors shall draw five numbered
1-43 single-member districts for electing directors and may revise the
1-44 districts as necessary or appropriate. For the conduct of an
1-45 election under this section, the board shall provide for one
1-46 director to be elected from each of the single-member districts. A
1-47 director elected from a single-member district represents the
1-48 residents and property owners of that single-member district.
1-49 Board elections shall be held on a uniform election day in
1-50 even-numbered years and shall be conducted according to Sections
1-51 36.017(b)-(h), Water Code, and the Election Code. [After the
1-52 election of directors at the confirmation election held under
1-53 Section 9 of this Act, regular elections for a portion of the board
1-54 of directors shall be held in each even-numbered year. The
1-55 directors elected from commissioners precincts 1 and 3 and the
1-56 director elected at large at the confirmation election shall serve
1-57 as directors until the first regular meeting of the board after the
1-58 second regular election of directors, and the directors elected
1-59 from commissioners precincts 2 and 4 at the confirmation election
1-60 shall serve until the first regular meeting of the board after the
1-61 first regular election of directors.]
1-62 SECTION 5. (a) A director of the Collingsworth County
1-63 Underground Water Conservation District who is serving on the day
1-64 before the effective date of this Act shall serve until the
2-1 director's term expires.
2-2 (b) At the 2002 directors' election, the open board
2-3 positions shall be filled by the appropriate number of directors,
2-4 who shall be elected from single-member districts.
2-5 (c) At the 2004 directors' election, the remaining board
2-6 positions shall be filled by directors elected from the remaining
2-7 single-member districts.
2-8 (d) At each subsequent directors' election, the appropriate
2-9 number of directors shall be elected from single-member districts.
2-10 SECTION 6. This Act takes effect immediately if it receives
2-11 a vote of two-thirds of all the members elected to each house, as
2-12 provided by Section 39, Article III, Texas Constitution. If this
2-13 Act does not receive the vote necessary for immediate effect, this
2-14 Act takes effect September 1, 2001.
