No. 3679 77R5077 MI-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to extending the boundaries of the Galveston County 1-3 Navigation District No. 1. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. EXTENSION OF BOUNDARIES. Subject to a confirmation 1-6 election held as provided by Section 3 of this Act, the boundaries 1-7 of the Galveston County Navigation District No. 1 are extended to 1-8 include all of the land area of Galveston Island. 1-9 SECTION 2. FINDING OF BENEFIT. All of the land and other 1-10 property included within the boundaries of the district as extended 1-11 by this Act will be benefited by the works and projects that are to 1-12 be accomplished by the district under powers conferred by Section 1-13 59, Article XVI, Texas Constitution. The district is created to 1-14 serve a public use and benefit. 1-15 SECTION 3. CONFIRMATION ELECTION; ORDER OF ANNEXATION. (a) 1-16 The board of navigation and canal commissioners of the Galveston 1-17 County Navigation District No. 1 shall call and hold an election to 1-18 confirm the extension of the boundaries of the district under 1-19 Section 1 of this Act. 1-20 (b) The board of navigation and canal commissioners shall 1-21 conduct the election as provided by Sections 63.375-63.379, Water 1-22 Code, except that: 1-23 (1) the election must be held so as to include all of 1-24 the land territory of Galveston Island; 2-1 (2) the ballots for the election must be printed to 2-2 allow for voting for or against the proposition: "Annexation to 2-3 Galveston County Navigation District No. 1 of all of the land area 2-4 of Galveston Island not presently part of the district"; and 2-5 (3) if a majority of the voters voting in the election 2-6 favor the annexation, the board of navigation and canal 2-7 commissioners shall enter an order in its minutes annexing the 2-8 additional territory to the district. 2-9 (c) On and after the entry of the order required by 2-10 Subsection (b)(3) of this section, the annexed territory is a part 2-11 of the district for all purposes. 2-12 (d) If the order required by Subsection (b)(3) of this 2-13 section is not entered before the fifth anniversary of the 2-14 effective date of this Act, this Act expires. 2-15 SECTION 4. EFFECTIVE DATE. This Act takes effect immediately 2-16 if it receives a vote of two-thirds of all the members elected to 2-17 each house, as provided by Section 39, Article III, Texas 2-18 Constitution. If this Act does not receive the vote necessary for 2-19 immediate effect, this Act takes effect September 1, 2001.
