1-1 AN ACT
1-2 relating to the operation of the Nixon Hospital District of
1-3 Gonzales and Wilson Counties, Texas, and the DeWitt Medical
1-4 District.
1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-6 SECTION 1. Section 3, Chapter 644, Acts of the 59th
1-7 Legislature, Regular Session, 1965, is amended by adding Subsection
1-8 (c) to read as follows:
1-9 (c) The District may contract with the DeWitt Medical
1-10 District for the DeWitt Medical District to lease, manage, or
1-11 operate a health care facility located in the District.
1-12 SECTION 2. Section 7, Chapter 310, Acts of the 59th
1-13 Legislature, Regular Session, 1965, is amended to read as follows:
1-14 Sec. 7. The Board of Directors of said District shall elect a
1-15 president and secretary from their number to serve until the next
1-16 succeeding directors' election. A majority of the directors shall
1-17 constitute a quorum, and a concurrence of a majority shall be
1-18 sufficient in all matters pertaining to the business of the
1-19 District. Not by way of limitation, the Board shall have the
1-20 complete management and control of all the business of the
1-21 District, including but not limited to the power and authority to
1-22 negotiate and contract with any person or body, public or private,
1-23 to purchase or lease land, to construct and equip a hospital
1-24 system, and to operate and maintain a hospital or hospitals, and to
2-1 negotiate and contract with other political subdivisions of the
2-2 State or private individuals, associations or corporations for such
2-3 purposes, all as may be determined to be necessary or desirable for
2-4 said District by said Board. The District, through its Board of
2-5 Directors, may contract with the Nixon Hospital District of
2-6 Gonzales and Wilson Counties, Texas, for the District to lease,
2-7 manage, or operate a health care facility located in the Nixon
2-8 Hospital District of Gonzales and Wilson Counties, Texas. The[;
2-9 and said] Board shall have all powers necessary, convenient or
2-10 incidental to carry out the purposes for which said District is
2-11 created. The Board of Directors of said District shall serve
2-12 without compensation but may be reimbursed for actual expenses
2-13 incurred by them in the performance of their official duties upon
2-14 the approval of such expenses by the Board of Directors thereof.
2-15 All vacancies in the office of director shall be filled for the
2-16 unexpired term by appointment of the remainder of the Board. If
2-17 the number of directors is reduced to less than three (3), the
2-18 remaining directors shall immediately call a special election to
2-19 fill said vacancies. Upon failure to do so, a District Court may,
2-20 upon application of any voter or taxpayer of the District, issue a
2-21 mandate requiring such directors to call and hold such election.
2-22 SECTION 3. This Act takes effect immediately if it receives
2-23 a vote of two-thirds of all the members elected to each house, as
2-24 provided by Section 39, Article III, Texas Constitution. If this
2-25 Act does not receive the vote necessary for immediate effect, this
2-26 Act takes effect September 1, 2001.
