 1-7                            A BILL TO BE ENTITLED
 1-8                                   AN ACT
 1-9     relating to the operation of the Nixon Hospital District of
1-10     Gonzales and Wilson Counties, Texas, and the DeWitt Medical
1-11     District.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1. Section 3, Chapter 644, Acts of the 59th
1-14     Legislature, Regular Session, 1965, is amended by adding Subsection
1-15     (c) to read as follows:
1-16           (c)  The District may contract with the DeWitt Medical
1-17     District for the DeWitt Medical District to lease, manage, or
1-18     operate a health care facility located in the District.
1-19           SECTION 2.  Section 7, Chapter 310, Acts of the 59th
1-20     Legislature, Regular Session, 1965, is amended to read as follows:
1-21           Sec. 7. The Board of Directors of said District shall elect a
1-22     president and secretary from their number to serve until the next
1-23     succeeding directors' election.  A majority of the directors shall
1-24     constitute a quorum, and a concurrence of a majority shall be
1-25     sufficient in all matters pertaining to the business of the
1-26     District.  Not by way of limitation, the Board shall have the
1-27     complete management and control of all the business of the
1-28     District, including but not limited to the power and authority to
1-29     negotiate and contract with any person or body, public or private,
1-30     to purchase or lease land, to construct and equip a hospital
1-31     system, and to operate and maintain a hospital or hospitals, and to
1-32     negotiate and contract with other political subdivisions of the
1-33     State or private individuals, associations or corporations for such
1-34     purposes, all as may be determined to be necessary or desirable for
1-35     said District by said Board.  The District, through its Board of
1-36     Directors, may contract with the Nixon Hospital District of
1-37     Gonzales and Wilson Counties, Texas, for the District to lease,
1-38     manage, or operate a health care facility located in the Nixon
1-39     Hospital District of Gonzales and Wilson Counties, Texas.  The[;
1-40     and said] Board shall have all powers necessary, convenient or
1-41     incidental to carry out the purposes for which said District is
1-42     created.  The Board of Directors of said District shall serve
1-43     without compensation but may be reimbursed for actual expenses
1-44     incurred by them in the performance of their official duties upon
1-45     the approval of such expenses by the Board of Directors thereof.
1-46     All vacancies in the office of director shall be filled for the
1-47     unexpired term by appointment of the remainder of the Board.  If
1-48     the number of directors is reduced to less than three (3), the
1-49     remaining directors shall immediately call a special election to
1-50     fill said vacancies.  Upon failure to do so, a District Court may,
1-51     upon application of any voter or taxpayer of the District, issue a
1-52     mandate requiring such directors to call and hold such election.
1-53           SECTION 3.  This Act takes effect immediately if it receives
1-54     a vote of two-thirds of all the members elected to each house, as
1-55     provided by Section 39, Article III, Texas Constitution.  If this
1-56     Act does not receive the vote necessary for immediate effect, this
1-57     Act takes effect September 1, 2001.
