No. 3693 77R13084 QS-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the creation, administration, powers, duties, 1-3 operation, and financing of the Lake Granbury Water Improvement 1-4 District. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. CREATION. (a) A conservation and reclamation 1-7 district, to be known as the Lake Granbury Water Improvement 1-8 District, is created in Hood County. The district is a governmental 1-9 agency and a body politic and corporate. 1-10 (b) The district is created under and is essential to 1-11 accomplish the purposes of Section 59, Article XVI, Texas 1-12 Constitution. 1-13 (c) The district is created without the necessity of holding 1-14 a confirmation election. 1-15 SECTION 2. DEFINITIONS. In this Act: 1-16 (1) "Board" means the board of directors of the 1-17 district. 1-18 (2) "District" means the Lake Granbury Water 1-19 Improvement District. 1-20 (3) "Retail sewer utility" means any person, 1-21 corporation, public utility, water supply or sewer service 1-22 corporation, municipality, political subdivision, or agency 1-23 operating, maintaining, or controlling in this state facilities for 1-24 providing sewer service for compensation. 2-1 SECTION 3. BOUNDARIES. The district includes the territory 2-2 contained within the following area: 2-3 BEGINNING at a point at the Northeast corner of the Hood County, 2-4 Texas line and the Northwest corner of the Johnson County, Texas 2-5 line, also being on the South line of Parker County, Texas; 2-6 THENCE, South along the East line of Hood County and the West line 2-7 of Johnson County to a point in the south of line of the R.B. FINDINGS RELATIVE TO BOUNDARIES. The legislature 12-27 finds that the boundaries and field notes of the district form a 13-1 closure. A mistake in the field notes or in copying the field notes 13-2 in the legislative process does not affect the organization, 13-3 existence, or validity of the district, the right of the district 13-4 to impose taxes, or the legality or operation of the district or 13-5 its governing body. 13-6 SECTION 5. FINDING OF BENEFIT. All of the land and other 13-7 property included within the boundaries of the district will be 13-8 benefited by the works and projects that are to be accomplished by 13-9 the district under powers conferred by Section 59, Article XVI, 13-10 Texas Constitution. The district is created to serve a public use 13-11 and benefit. 13-12 SECTION 6. GENERAL POWERS. (a) The district has all of the 13-13 rights, powers, privileges, authority, functions, and duties 13-14 provided by the general law of this state, including Chapters 30, 13-15 49, and 54, Water Code, applicable to municipal utility districts 13-16 created under Section 59, Article XVI, Texas Constitution, except 13-17 that the district does not have any of the powers provided in 13-18 Section 54.201(b), Water Code, except for the powers provided in 13-19 Section 54.201(b)(2) to collect, transport, process, dispose of, 13-20 and control all domestic, industrial, and communal wastes, whether 13-21 in fluid, solid, or composite state. This Act prevails over any 13-22 provision of general law that is in conflict or inconsistent with 13-23 this Act. 13-24 (b) The rights, powers, privileges, authority, functions, 13-25 and duties of the district are subject to the continuing right of 13-26 supervision of the state to be exercised by and through the Texas 13-27 Natural Resource Conservation Commission. 14-1 SECTION 7. BOARD OF DIRECTORS. (a) The district is 14-2 governed by a board of eight directors. 14-3 (b) Temporary directors serve until initial directors are 14-4 elected under Section 10 of this Act. 14-5 (c) Initial directors serve until permanent directors are 14-6 elected under Section 11 of this Act. 14-7 (d) Permanent directors serve staggered four-year terms. 14-8 (e) A director serves until the director's successor has 14-9 qualified. 14-10 SECTION 8. TEMPORARY DIRECTORS. (a) The temporary board of 14-11 directors consists of: 14-12 (1) Larry Brockman, Precinct ____; 14-13 (2) Ron Cullers, Precinct ____; 14-14 (3) Susan Cummet, Precinct ____; 14-15 (4) Larry Kemp, Precinct ____; 14-16 (5) G. Holman King, Precinct ____; 14-17 (6) Clyde Perry, Precinct ____; 14-18 (7) James L. Shultz, Precinct ____; and 14-19 (8) J. C. Wright, Precinct ____. 14-20 (b) The temporary directors shall take the oath of office 14-21 and execute bonds to qualify for holding their offices as soon as 14-22 possible after the effective date of this Act. 14-23 (c) If a temporary director fails to qualify for office, the 14-24 temporary directors who have qualified shall appoint a person to 14-25 fill the vacancy. If at any time there are fewer than five 14-26 qualified temporary directors, the Texas Natural Resource 14-27 Conservation Commission shall appoint the necessary number of 15-1 persons to fill all vacancies on the board. 15-2 SECTION 9. METHOD OF ELECTING DIRECTORS. (a) The territory 15-3 within the district shall be divided into four voting precincts 15-4 along the same lines as the precincts established by the Hood 15-5 County Commissioners Court for the election of county 15-6 commissioners. The board may adjust the precinct boundaries as 15-7 necessary to provide for proper representation of voters within the 15-8 district if the district annexes land or if otherwise required by 15-9 law. 15-10 (b) Two directors shall be elected from each voting precinct 15-11 by the voters of that precinct. The candidate who receives the 15-12 highest number of votes and the candidate who receives the second 15-13 highest number of votes in a precinct shall serve as the directors 15-14 from that precinct. 15-15 (c) To be qualified to be a candidate for or to serve as 15-16 director, a person must reside in and be a registered voter in the 15-17 voting precinct that the person seeks to represent. 15-18 SECTION 10. INITIAL DIRECTORS' ELECTION. (a) On the first 15-19 Saturday in May 2002, the temporary board shall hold an election to 15-20 elect eight initial directors as provided by the Election Code and 15-21 Chapters 49 and 54, Water Code. 15-22 (b) At the initial directors' election, the temporary board 15-23 shall have placed on the ballot the name of any candidate filing 15-24 for an initial director's position and blank spaces to write in the 15-25 names of other persons. A temporary director who is qualified to 15-26 be a candidate under Section 9 of this Act may file for an initial 15-27 director's position. 16-1 (c) Of the two directors initially elected from each 16-2 precinct within the district, the director with the most votes 16-3 shall serve a term ending in May 2006, and the other director shall 16-4 serve a term ending in May 2004. 16-5 (d) At the election, the board may submit to the voters 16-6 propositions to authorize issuance of bonds, a maintenance tax, and 16-7 a tax to make payments under a contract. 16-8 SECTION 11. ELECTION OF DIRECTORS. On the first Saturday in 16-9 May of each even-numbered year, the appropriate number of directors 16-10 shall be elected. 16-11 SECTION 12. EXCLUSION OF LAND FROM THE DISTRICT. (a) Land 16-12 may be excluded from the district as provided by Chapters 49 and 16-13 54, Water Code, and as provided by this section. 16-14 (b) Not later than two months after the temporary directors 16-15 qualify for office, the district shall provide written notice to 16-16 each retail sewer utility providing retail sewer utility service 16-17 within the boundaries of the district, according to the records of 16-18 the Texas Natural Resource Conservation Commission, stating: 16-19 (1) the existence of the district and its purposes; 16-20 and 16-21 (2) that the governing body of a retail sewer utility 16-22 may request that any area in the district in which the retail sewer 16-23 utility is providing retail sewer utility service be excluded from 16-24 the boundaries of the district. 16-25 (c) Notice provided under this section must be sent by 16-26 certified mail, return receipt requested. 16-27 (d) To have territory excluded from the district, a retail 17-1 sewer utility must file a written resolution with the district not 17-2 later than the 60th day after the date of receipt of the notice by 17-3 the retail sewer utility. The resolution must contain an accurate 17-4 description of the area to be excluded. 17-5 (e) At its next meeting after receiving a written 17-6 resolution, the board shall adopt an order excluding the area 17-7 described in the written resolution and redefining the boundaries 17-8 of the district to reflect the exclusion. 17-9 (f) Notwithstanding Subsections (b)-(e) of this section, a 17-10 retail sewer utility that is a municipality may, not later than one 17-11 year after the effective date of this Act, file with the district a 17-12 written resolution of the city council of the municipality 17-13 requesting that all or any part of the area within the corporate 17-14 limits or extraterritorial jurisdiction of the municipality be 17-15 excluded from the boundaries of the district if the area is not 17-16 within the service area of another retail sewer utility. Upon 17-17 receipt of a written resolution, the board shall, at its next 17-18 meeting, adopt an order excluding the area and redefining the 17-19 boundaries of the district to reflect the exclusion. 17-20 (g) It is expressly acknowledged for purposes of this Act 17-21 that the City of Granbury, in Hood County, Texas, is a retail sewer 17-22 utility. 17-23 SECTION 13. FINDINGS RELATING TO PROCEDURAL REQUIREMENTS. 17-24 (a) The proper and legal notice of the intention to introduce this 17-25 Act, setting forth the general substance of this Act, has been 17-26 published as provided by law, and the notice and a copy of this Act 17-27 have been furnished to all persons, agencies, officials, or 18-1 entities to which they are required to be furnished by the 18-2 constitution and other laws of this state, including the governor, 18-3 who has submitted the notice and Act to the Texas Natural Resource 18-4 Conservation Commission. 18-5 (b) The Texas Natural Resource Conservation Commission has 18-6 filed its recommendations relating to this Act with the governor, 18-7 lieutenant governor, and speaker of the house of representatives 18-8 within the required time. 18-9 (c) All requirements of the constitution and laws of this 18-10 state and the rules and procedures of the legislature with respect 18-11 to the notice, introduction, and passage of this Act are fulfilled 18-12 and accomplished. 18-13 SECTION 14. EFFECTIVE DATE. This Act takes effect 18-14 immediately if it receives a vote of two-thirds of all the members 18-15 elected to each house, as provided by Section 39, Article III, 18-16 Texas Constitution. If this Act does not receive the vote 18-17 necessary for immediate effect, this Act takes effect September 1, 18-18 2001.
