No. 237 77R11326 CCK-D HOUSE CONCURRENT RESOLUTION 1-1 WHEREAS, Under state law, the legislature is authorized to 1-2 designate a site of unique value for the construction of a 1-3 reservoir; and 1-4 WHEREAS, A site on the Double Mountain Fork of the Brazos 1-5 River, in southern Stonewall County, merits such a designation by 1-6 virtue of the storage and conservation advantages that a dam and 1-7 reservoir at this location would afford; and 1-8 WHEREAS, The construction and development of such a project, 1-9 and the associated impoundment, diversion, and use of the 1-10 unappropriated flows of the Brazos River, are in the public 1-11 interest and would constitute a beneficial use of the water; and 1-12 WHEREAS, Conditions warrant a Texas Water Development Board 1-13 waiver of the requirement that the project meet needs in a manner 1-14 consistent with the state and regional water plans; and 1-15 WHEREAS, The cost of acquisition of the site for the project 1-16 exceeds the current financing capabilities of the area involved, 1-17 and the optimum regional development of the project cannot be 1-18 reasonably financed by local interests without state participation; 1-19 and 1-20 WHEREAS, It is therefore the intent of the legislature that 1-21 the project receive priority for existing and uncommitted bond 1-22 authorization in the state participation account of the Texas Water 1-23 Development Fund II; and 1-24 WHEREAS, The legislature finds it reasonable to expect that 2-1 the state, in using that account to acquire up to 50 percent of the 2-2 undivided interest in the project in partnership with local or 2-3 regional interests, will recover its investment in the project; 2-4 now, therefore, be it 2-5 RESOLVED, That the 77th Legislature of the State of Texas, 2-6 exercising its authority under Section 16.051(f)(2), Water Code, 2-7 hereby designate the Double Mountain Fork of the Brazos River in 2-8 southern Stonewall County as a site of unique value for the 2-9 construction of a reservoir; and, be it further 2-10 RESOLVED, That the secretary of state forward an official 2-11 copy of this resolution to the executive director of the Texas 2-12 Water Development Board.
