HOUSE CONCURRENT RESOLUTION 1-1 WHEREAS, House Bill No. 1245 has been adopted by the house of 1-2 representatives and the senate and is being prepared for 1-3 enrollment; and 1-4 WHEREAS, The bill contains technical errors that should be 1-5 corrected; now, therefore, be it 1-6 RESOLVED by the 77th Legislature of the State of Texas, That 1-7 the enrolling clerk of the house of representatives be instructed 1-8 to correct House Bill No. 1245 as follows: 1-9 (1) Strike Section 3.410, Family Code, as added by Senate 1-10 Committee Amendment No. 1, and substitute the following: 1-11 Sec. 3.410. EFFECT OF MARITAL PROPERTY AGREEMENTS. A 1-12 premarital or marital property agreement, whether executed before, 1-13 on, or after September 1, 1999, that satisfies the requirements of 1-14 Chapter 4 is effective to waive, release, assign, or partition a 1-15 claim for economic contribution under this subchapter to the same 1-16 extent the agreement would have been effective to waive, release, 1-17 assign, or partition a claim for reimbursement under the law as it 1-18 existed immediately before September 1, 1999, unless the agreement 1-19 provides otherwise. 1-20 (2) Strike SECTION 6(c) of the Act, as added by Senate 1-21 Committee Amendment No. 1, and substitute the following: 1-22 (c) Section 3.410, Family Code, as added by this Act, 1-23 applies to a premarital property agreement or marital property 1-24 agreement executed before, on, or after September 1, 1999.
