                             HOUSE CONCURRENT RESOLUTION
 1-1           WHEREAS, House Bill No. 6 has been adopted by the house of
 1-2     representatives and the senate and is being prepared for
 1-3     enrollment; and
 1-4           WHEREAS, The bill contains technical errors that should be
 1-5     corrected; now, therefore, be it
 1-6           RESOLVED by the 77th Legislature of the State of Texas, That
 1-7     the enrolling clerk of the house of representatives be instructed
 1-8     to correct House Bill No. 6 as follows:
 1-9           (1)  On page 7 of the conference committee report, line 21,
1-10     strike "Section 12.1055" and substitute "Subsection (a)".
1-11           (2)  On page 7 of the conference committee report, line 33,
1-12     strike "Local".
1-13           (3)  On page 8, line 19, of the conference committee report,
1-14     strike "Sections 12.106-12.108" and substitute "Sections 12.106 and
1-15     12.107".
1-16           (4)  On page 10 of the conference committee report, between
1-17     lines 14 and 15, insert the following:
1-18           SECTION 8.  Subchapter D, Chapter 12, Education Code, is
1-19     amended by adding Section 12.1071 to read as follows:
1-20           Sec. 12.1071.  EFFECT OF ACCEPTING STATE FUNDING. (a)  A
1-21     charter holder who accepts state funds under Section 12.106 after
1-22     the effective date of a provision of this subchapter agrees to be
1-23     subject to that provision, regardless of the date on which the
1-24     charter holder's charter was granted.
 2-1           (b)  A charter holder who accepts state funds under Section
 2-2     12.106 after September 1, 2001, agrees to accept all liability
 2-3     under this subchapter for any funds accepted under that section
 2-4     before September 1, 2001.  This subsection does not create
 2-5     liability for charter holder conduct occurring before September 1,
 2-6     2001.
 2-7           SECTION 9.  Section 12.108, Education Code, is amended to
 2-8     read as follows:
 2-9           (5)  On page 35 of the conference committee report, line 26,
2-10     strike "Sections 12.1101 and 12.1131" and substitute "Section
2-11     12.1101".
2-12           (6)  On page 35 of the conference committee report, line 27,
2-13     strike "apply" and substitute "applies".
2-14           (7)  On page 35 of the conference committee report, lines 29
2-15     and 30, strike "or a charter for an open-enrollment charter school
2-16     granted by the board".
2-17           (8)  On page 35 of the conference committee report, line 31,
2-18     strike "or a charter granted".
2-19           (9)  Renumber the subsequent SECTIONS of the bill
2-20     accordingly.
