No. 9 77R5411 CAS-F A JOINT RESOLUTION 1-1 proposing a constitutional amendment to remove the prohibition 1-2 against perpetual trusts. 1-3 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Section 26, Article I, Texas Constitution, is 1-5 amended to read as follows: 1-6 Sec. 26. Perpetuities and monopolies are contrary to the 1-7 genius of a free government, and shall never be allowed, nor shall 1-8 the law of primogeniture or entailments ever be in force in this 1-9 State. This section does not apply to perpetual trusts. 1-10 SECTION 2. This proposed constitutional amendment shall be 1-11 submitted to the voters at an election to be held November 6, 2001. 1-12 The ballot shall be printed to permit voting for or against the 1-13 proposition: "The constitutional amendment removing the 1-14 prohibition against perpetual trusts."
